     Procuratorial power has dual attributes of judicial power and administrative power, which means the exercise of procuratorial power should conform to judicial regularities on the one hand, which are independent in nature, and administrative regularities on the other hand, which are influenced by administrative orders. The dual attributes also have a direct bearing on the judicial accountability system. That is to say, only when the prosecutor exercises the procuratorial power with judicial traits, will he have to take judicial accountability. If the prosecutor exercises the procuratorial power with administrative traits, he will take no or part of accountability while the superior who has issued the order should assume all or major accountability. China's procuratorial power is essentially sort of judicial power with administrative characteristics which have been improperly strengthened in the past. Therefore, today's procuratorial reform should focus on “deadministration” by gradually weakening the administrative attribute of procuratorial power. There are some certain differences between a prosecutor's and a judge's independence in that the former’s independence is relative due to the restriction from the framework of procuratorial integration. A full understanding of this serves as a premise of constructing a scientific and reasonable judicial accountability system for procuratorial personnel.

    (School of Art, Beijing University, Beijing  100871, China)Abstract: The paper analyzes Bernard Stiegler’s philosophy on cinema. Stiegler proposed the concept of “tertiary retention” based on Husserl’s two forms of memory: primary retention (perception) and secondary retention (recollection). Stiegler holds that audiovisual recording technologies create in a film “a container of consciousness” which becomes a memorylike “time object”, which can unfold itself only in time, or in other words, a copy of consciousness that can bring the past into the present as needed. “Tertiary retention”, depending on external material storage, however, is being industrialized rapidly, which has resulted in two consequences. Firstly, cinema and human consciousness are highly assimilated, leading to the collapse of the economy of desire; Secondly, man’s general aesthetic experiences have been transformed, and modulated by refined digital technologies, causing the loss of man’s primitive capability of selflove and image destruction due to blindness, a phenomenon called “symbolic misery” by Stiegler.

    Syd Field is a renowned screenwriting theorist, as famous as Robert McGee. Field’s Screen Play: The Foundations of Screenwriting is regarded as a bible to screenwriting beginners. His theories of screenwriting underscore basics, effects and practicality. The “threeact structure” and the fourquarter tip proposed by Field reflects the trace of traditional influence and the importance of two major plot points ina screen play, holding that top priorities should be given to the end instead of the beginning in plot planning. As the founder of the modern screenwriting theories, Field is also a forerunner and practitioner of the study of the screenwriting, a mentor and guru to screenwriting learners. On the other hand, Fields’ screenwriting theories are comparatively conservative and care less about nonlinear narrative movies.

    “Fen san weiyi”(integrating the three into one) in Yang Xiong’sDenouncing Qin and Commending Xin selected by ZhaomingAnthology of Literature was interpreted by Li Shan andother five ministers as merging three articles into one, namely, Yao Dian, Shun Dian and the newly created Di Dian. Nevertheless, it is a misinterpretation. In effect, “Fen san weiyi” originated from the conception of “wangdaotong san”(the kingly way is mediating the three elements: heaven,earth and man”). “Wang Dao Tong San” was the core concept of kingly way, which emphasized the subservience of the populace to the King, and the King to heaven, on the basis of the harmony between heaven and man. The theory was very innovative and adjusted to the political and cultural environments in Han Dynasty. The Empire of Han was politically superior to the previous monarchs, ideologically inclusive and characteristic of the spirit of grand unification. Its kingly wayhighly manifested the spirit of thetimes by assimilating different schools of ideas while presenting new connotations.

    The imperial court literati represented by Shi Runzhang, Wei Yijie and FengPuconducted a series of the rectifications and regulations. They reiterated the didactical functions of poetry by criticizing the poetic style in the late Ming Dynasty and returning to the Confucianist poetic instruction. They reflected on the poetic style in the early Qing Dynasty and advocated righteous styles and elegance. They assigned a dominant role to “elegance and righteousness” and poetic morality in Tang Dynasty while assimilating achievements by previous dynasties and recognizing the value of poetry in Song Dynasty and Ming Dynasty with restraint. Based on these practices, they constructed the poetic ideology of the Qing Dynasty. The poetic regulations set by them met the needs of the Qing government to reconstruct political ideology.

    Language, Essence and World: A Reanalysis of Wittgenstein’sLanguage Philosophy

    It is unanimously acknowledged that Wittgenstein’s philosophy of language is the core of his general philosophy, which has undergone the transition from the theory of “language picture” to the theory of “language game”. The later philosophy of Wittgenstein features the view of antiessence and the view of ordinary language. Considering his opinion of antiessence, the paper holds that there exists no ultimate essence but the partial essence which executes its relevant role at certain systematic level. As to Wittgenstein’s philosophy of ordinary language, from the perspectives of “languageworld” relationship, diversities and openness of language, the paper points out that the language is determined by world, and language analysis is not transcendentally selfreliant and closed, therefore is not capable of solving all philosophical questions. In spite of its limitations, it is pointed out that Wittgenstein’s theory has made great contributions to the development of the philosophy of language.

    Schiller brought aesthetic education into real life, holding that aesthetic education, connectingtwo conflicting states—sense and reason, was the key to eliminating the conflict. He criticized the alienation of human nature and argued for the rebirth of man through aesthetic play; he pinned hope on aesthetic education to realize man’s freedom by proposing play drive to solve the confrontation between sense drive and form drive; he realized the confinement of man’s activities and wills in a kingdom of power and ethics and the capability of aesthetic kingdom in empowering true freedom, thus embracing the hope that aesthetic education would transform society.

    The Evolution of Service Innovation Researches and Its Implications #br# for China: Based on Foreign Literature Review

     Service innovation, which has been under research since Schumpeter’s time, still remains as a vague concept. Because different options on the essence of service innovation exist among scholars, no agreement on the definition of service innovation has been reached. Despite of studies abundantly made in the scope of service innovation, conclusions diverge, leading to the research “bottleneck”. The development course and the content of the service innovation researches is yet to be clarified due to lack of related studies and systematic literature review. Employing the method of concept clarification, this research, through a systematic and comprehensive review on service innovation literature during the period of 19962016, clarifies the development course and summarizes the content and categories of the researches under discussion. The research findings include: (1) the researches during the current period, taking Schumpeter’s innovation theory as the step stone, carried out the exploration from a socalled “inward perspective”; (2) most researches focused on the following four themes: degree of change, category of change, newness of change, and source of change; (3) the researches during the current period paid inadequate attention to value cocreation, ignoring the necessity and importance of profit return brought by service innovation. Based on these findings, the paper evaluates the service innovation researches during the current period by identifying the main trend and major problems and weaknesses, and presents the following recommendations: service innovation needs to be reexamined by shifting from the “inward perspective” to the “outward perspective” based on customer experience and value cocreation; the forthcoming researches should change current cognitive logic to make indepth research. The paper, besides making up the deficiency of literature reviewbased research, sheds light on the solutions to the bottleneckrelated problems of research development, and provides the service industries, especially highend service industries in China, with some preparative foundation and theoretical references.

    PPP projects  have become the new engine to boost investment, and an important power to stabilize development, optimize structure, overcome weaknesses and improve social welfare in the past three years. Currently, China has become the world’s largest market for PPP projects, however, as PPP grows vigorously in China, problems arise such as low rate of PPP contract signing, inactive participation of private capital, low rate of return on investment as well as difficulty in and high cost of financing and unbalanced risk sharing. The paper proposes the State strengthen top design for PPP, optimize related legislation, increase the confidence of investors, lower access threshold of PPP projects, expand subjects of market participation, solve financing problems and set up an appropriate rate of return on investment so as to achieve normative, orderly and healthy development of PPP projects.

    Within the disciplinary and antidisciplinary framework, a case study of “A” town in a suburb of Cixi City in Zhejiang Province reveals that market logic and administrative logic account for the respective behavior of street vendors and Chengguan whose strategies employed in the game include three combinations: escape and chase, pleading and lecturing, violent resistance and confiscation of properties. The evolution of strategy combinations projects the evolution and upgrading of the game, which further strengthens the informalization of informal space, thus reshaping the urban informal economy and public space. On the microscopic scale, the effectiveness of the game strategies depends on how local government and the grassroot law enforcement officers in particular control the game from escalating into the limit of tolerance on both sides.

    The Impact of “Universal TwoChild Policy” on Urban Women’s Employment Quality

    Under the implementation of China’s “Universal TwoChild Policy”, the impact of rebirth on employment quality becomes an important reference index influencing urban women’s decision on rebirth and once again draws the attention of the whole society. The study shows that job characteristics and work environment as incentive factors have significant influence on women’s employment quality. Labor relations, work value and social environmentrelated factors belong to nondominant and healthcare factors. Besides, giving birth has a significant negative nonlinear effect on the urban women’s wage rate since the birth of a new child will decrease the mother’s wage rates by 9% 10%, thus verifying the universality of the “childbearing price”. In view of this, both the government and employers should gradually create a sound environment protecting female employment, constantly improve the care support system, enhance fertilityrelated governance, and coordinate between the smooth implementation of the new birth policy and the preservation and appreciation of female human capital.

    Both ritual and law symbols are abstracted forms and regulations from phenomena of complex social life, specifying people’s acts of representation. The hierarchicaldivision of rites controls the stratification of society and ritual stability maintains the stability of social order. Law is rooted in the rites, but Legalists emphasized shi (power) by employing shu(means), mainly due to their goal of rebuilding symbolic dominance for the ruling classes. Legalists’ practical inclination met the needs of unification, but veered into extreme utilitarianism without the value of restraint. In this sense, the mutual complementarity of rites and law was an affirmation of the restraint value of the selfdisciplined Confucian morality. The essence of external Confucianism and internal legalism indicates that “the value of drive and the value of restraint share the same source”, while unitary “rites” as metalanguage constitute an impediment to social development in the course of historical evolution due to the lack of necessary symbol drive.
