摘要：  2009版《循环经济促进法》已经不具有现实适应性，对其修改正在进行中。必须认识到《循环经济促进法》担负着经济发展方式转型和推动产权制度改革深化的重任，《循环经济促进法》的制定与修改特别值得关注。我国循环经济的发展存在制度性结构错位，《循环经济促进法》制度设计中涉及该法的理性定位，循环经济战略与规划，循环经济监管体制等重大制度变革，在《循环经济促进法》修订时需要慎重以待。

Abstract:  the Circular Economy Promotion Law of the 2009 edition cannot accommodate to the reality, its revision is in progress. The formulation and revision of the Law deserves particular attention since it shoulders the important mission of pushing forward the transformation of the mode of economic development and the reform of the property rights system.Given the systemic structural dislocation dampening the development of China's circular economy, we should take prudent consideration into the following issues while amending the Circular Economy Promotion Law: rational positioning of the Law, strategic planning of circular economy and major systemic reforms such as the reform of the supervision mechanism of circular economy.
