The Rural Rejuvenation Initiative in the Perspective of #br# Ecocivilization and Comparison
Journal of Shanghai University (Social Science Edition)    2018, 35 (1): 1-10.
    Abstract728)            Save

Global climate change plays an important part in affecting the social transformations of mankind. When we take into account such elements as the longterm interaction between the climateassociated stable agricultural societies and mobile nomad nationalities and geological diversity caused by Asian continental climate in the comparative perspective, we can have a more indepth understanding of the internal logic of China's political forms, cultural continuity and the lowcost rural autonomy, thus better recognizing the historical significance of the initiatives of ecocivilization and rural rejuvenation. Under current situation, it is essential for China to strengthen weak links and rebalance development, implement in all respects such important strategies as ecocivilization and rural rejuvenation initiatives, and enhance the Central Government's competence of comprehensive coordination during conversion period and local governments' capability of consolidating rural foundation to respond to softlanding so as to ensure China as the largest developing country to maintain steady growth in the process of globalization.

The study of those longestablished “nameless but real” social enterprises and entrepreneurs in modern Chinese history are still rarely seen in the current research literatures of social enterprises. At the inception of industrialization in modern China, the social cultural traditions and indigenous resources nurtured private national industries with the nature of social enterprises. Those manufacturing industries with factories set up in the local rural areas and serving for the local construction are defined as the “indigenous social enterprises”.This article takes “Da Sheng Group” set up by one of China’s earliest social entrepreneurs Zhang Jiang and its indigenous “Nantong Autonomy” as a case study, analyzes how indigenous social enterprises optimally allocated local resources, took full advantage of the indigenous social resources, conducted operations based on internalized resources and returned all of the profit to the local construction in all respects so as to achieve effective governance of the indigenous society through the integration of “manufacturing, education and public welfare”.

External Subjects and Rural Society in Modern China: A Case Study #br# of “Xindu Experiment” Led by Chinese National Association of Mass #br# Education Movement
Journal of Shanghai University (Social Science Edition)    2018, 35 (1): 23-34.
    Abstract520)            Save

School of Chinese Rural Construction, Southwest University, Chongqing 400715, China)Abstract: “Xindu Experimental County”was founded in April, 1937, cooperated by Sichuan Provincial Government and the Chinese National Association of Mass Education Movement (CNAMEM) led by Y. C. James Yen, who set the reform of county governments and rural construction as two major goals. The county officials were mainly composed of members of CNAMEM and graduates of Central Political University. But less than two years later, the experimental county became only an empty title due to “Xindu Incident”. This paper examines such factors as the experimental process, system construction, financial expenditure and farmer's burden to explore the underlying causes of “Xindu Incident” from the theoretical perspective of transaction cost or system cost.It reveals a paradox: the more vigorous effort the external subjects exerted in promoting modern governance in rural society, the higher transaction cost with scattered farmers; meanwhile, the cost in maintaining a large organizational structure, higher cost in restructuring and financial deficits were further transferred to the populace, resulting in the rebel of local forces which further exacerbated into a massive incident. After the failure of the experiment, two county magistrates established close friendship with the local brotherhood organization—paoge, and even joined them, returning to the old way of rural governance which relied heavily on nonofficial but costefficient social organizations.

Identity and Expressions: Taishi Gong, Zhongshu Ling and the #br# Writing of Historical Records—Centered on the Different Beginning #br# of “A Letter to Shaoqing Ren” in Selected Works

Sima Qian’s “A Letter to Shaoqing Ren” is a fundamental document in the reception history of Historical Records, in which he elaborately expounded on the reasons for history compiling.Yet one puzzle remains to be solved, i.e. why did Sima Qian proclaimed himself as Taishi Gong while his real identity was Zhongshu Ling, a favored eunuch by the Emperor. As Zhongshu Ling, Sima Qian was loyal to the Emperor Wu, which accounts for his eulogy to Han Dynasty in Historical Records, but Zhongshu Ling was not respected by his contemporaries, so he would prefer the title of “Taishi Gong” which was much more respected in the tradition of historian culture. In “Biography of Sima Qian” in The Book of Former Han,Sima Qian was simply presented as Zhongshu Ling, and the beginning words by “Taishi Gong” was simply omitted. In the period of Liang Dynasty (502557), the cultural identity of Taishi Gong was respected, so Taishi Gong’s words were restored in “A Letter to Shaoqing Ren” in Selected Works, thus making it consistent with the content. However, neither the omission of The Book of Former Han nor the restoration in Selected Works observed Sima Qian’ inner struggles and “Taishi Gong complex”.

“Simply at a Loss Then”: Revisiting Lust, Caution Ten Years Later with Lacanian Psychoanalysis
Journal of Shanghai University (Social Science Edition)    2018, 35 (1): 46-59.

Lust, Caution directed by Ang Lee in 2007 left a strong mark in the history of Chinese cinema as well as cinematic arts per se. Adapted from Eileen Chang’s novel of the same name, the film won many titles including the Golden Lion Award at the Venice Film Festival and seven awards from the Golden Horse Awards in Taiwan. Even up to now it has remained a hot topic due to its exaggerated size in depicting “lust”. From the perspective of Lacanian psychoanalysis, the paper revisits Ang Lee's Lust, Caution ten years later, aiming to point out that the three grand sexual scenes that Ang Lee paid greatest attention to and a great price for as well, were nothing but“destructive redundancy”.

The Real Existence of the Suspect X: The Philosophy in the #br# Film The Dedication of the Suspect X

    Abstract640)            Save

Keigo Higashino’s novel The Dedication of the Suspect  X was adapted and shot against the background of China, in which specific elements were not simply swamped into those catering to Chinese habits.  One thing worth mentioning is that in the Chinese version of The Dedication of the Suspect X, the killing of Fu Jian is presented  in the middle of the narrative rather than at the begining. The shift  marks the transfer of the main thread of narration from the original protagonists Yasukoand Ishigami to the opposition between film characters Tang Chuan on the bright side and Shi Hong on the secretive side. The opposition between the two reflects exactly the contrast between visibility in physics and visibility in mathematics. At the end of the story, Chen Jing’s confession and surrendering herself to the police produced another strong singularity—the pathos, opposing to that of Shi Hong’s calculation. So, the real tension in the story is that between Shi’s logos and Chen’s pathos. In either Higashino’s novel or Su Youpeng’s film, the scale tilts to  pathos.

On the Application and Restrictive Interpretation of “Administrative Punishments” as Elements of Incrimination in Criminal Law

    Abstract660)            Save

“Administrative punishments” in the criminal law are atypical elements of incrimination, which put a premium on the expansion of criminals under the guidance of criminal policies, but none of current theories can fully demonstrate the rationality and necessity of administrative punishments as elements of incrimination, be it in the perspective of legal fiction, function of the guarantee of criminal law, or new forms of crimes. According to the modest principle of criminal law and the basic concept of venial penalty, the principle of exhaustion of administrative penalty should be followed at the level of criminal legislation, which means the types and extent of the administrative penalties that the actor receives should be exhausted. At the level of criminal justice, administrative punishments, as atypical elements, cannot be used alone as a demarcation for the division between criminal and administrative cases, but referring to the traditional standard of incrimination taking into account the nature and amount of crimes of each accusation. The elements of administrative punishments in Criminal Law should be applied with restrictive interpretation.

The regime of content inspection in picking up has become an important measure to effectively prevent forbidden or restricted items from entering into the delivering channels from the source. The regime of content inspection in picking up is characterized with statutory standards, dual function and complex operations. It includes internal and external legal relationships. In internal legal relationships, the express delivery enterprises have rights to inspect items for delivery, to require the senders to testify relevant information or to refuse picking up items; and as for senders, they have to fulfill the obligations to faithfully provide relevant information about delivery items, to inform the nature of special items and to accept content inspections. In external legal relationships, both enterprises and senders undertake necessary duty of care to others’ personal and property rights. Obviously, the performance of obligations cannot be separated from the ascertainment of liabilities, so in the process of deciding liabilities, types of obligations are taken into consideration to determine specific liabilities which should be distributed reasonably between the enterprises and the senders in accordance with degrees of faults.

The specific concept of quality characteristics is related to the economic, cultural and political accounting environments of different countries.Replacing “reliability” with “faithful representation” has certain rationality and institutional basis.“Substance over form” and “asymmetric prudence” should be retained to reflect the basic spirit of investor protection. “Materiality” and “measurement uncertainty” should be the “influence factors” of qualitative characteristics of accounting information. The hierarchy of accounting qualities should be restructured appropriately on the basis of such components as constraint conditions, quality characteristics, ingredients of primary qualities and influencing factorsso as to make it clear in concepts, explicit in connotation and consistent in functions.

#br# Characteristics of Insider Trading Cases and Supervision Defects in #br# China—Reflections on Legal Cases from 1998 to 2016
Journal of Shanghai University (Social Science Edition)    2018, 35 (1): 107-120.
    Abstract573)            Save

Based on the data collected from insider trading cases of all notices of penalties issued by the China Securities Regulatory Commission and court decisions from 1998 to 2016, this paper analyzes the main characteristics of China’s insider trading cases and the loopholes in the regulatory mechanism in terms of the subjects of insider trading, the definition of insider information, administrative punishments of insider trading, types of accountability and efficiency of regulatory enforcement. In recent years, China’s insider trading cases have grown rapidly, among which “company insiders” are mainly involved, “the subjects with illegal access to insider information” has increased dramatically, and acquisitions and reorganizations are the “hardest hit” area for insider trading. However, cases of inside trading are accompanied by low probability of discovery, long period of enforcement and less severe punishments on the whole, most of which fall to administrative penalties, few to criminal punishment, and rare to civil liability. Therefore, it is essential to perfect related legal systems as soon as possible to handle cases of insider trading, and expand the probability of exposure and the extent of punishments.

The relationship between the platform hegemony in the new media era and the reform of the Chinese media has drawed much attention, but under various pressures, few bother to reveal the truth. As the development of BAT (Baidu, Alibaba and Tecent) are restrained by other external factors and the ecological enivironment for traditional media is deteriorating, we need to reinterprete newly emerging problems like the relationship between news, advertisements and journalism. When plantform monopoly leads to media“socialization”, how to interprete the paradoxical relationship between the “mass line” approach adopted by the mainstream media and the marketization of public opinions? In this game of competing for new media, will macropolicies achieve winwin situation? It  is more urgent to explore or formulate the right approaches and policies to integrate the tranditional and emerging media, thus creating a mutual benefit and winwin situation. In the new media era, how to demonstrate that socialist market economy is for and by the overwhelming majority of people? It is where the publicness of Chinese media reveal most and where the largest challenge lies.

A Proposal of Regulating P2P Network Lending in Accordance with the Securities Law
Journal of Shanghai University (Social Science Edition)    2018, 35 (3): 1-9.
    Abstract499)            Save
P2P network lending is currently under the jurisdiction of the China Banking Regulatory Commission (CBRC). The practice is a mistaken scheme brought by literal misunderstanding. As most P2P network lending products meet the elements required by “investment contracts”, they should be categorized into “securities” and supervised by the China Securities Regulatory Commission (CSRC). Since P2P loans take place without intermediaries as direct rather than indirect financing, CBRC cannot conduct prudential supervision over them. Since the issuers of the lending products of P2P network do not have a license, local governments cannot regulate them in the same way as regulate institutions. In addition, according to the “twin peaks supervision theory”, behavior supervision and prudential supervision are two different types of supervisions with distinctive characteristics and styles. But the main task of CBRC is to conduct prudential supervision over largescale depository institutions, so the regulation of P2P network lending by CBRC is not a proper choice.

Landscape and Topography in Riding Alone for Thousands of MilesLaurence Simmons1

Film narration and presentation of landscapes are closely interconnected. In general cases, landscapes are present in many films but their presence is marginal. Essentially, landscape in film is an atmosphere for a story, a setting for action, there, but always “in the background”. There is no film genre called “landscape film” as in painting. In contrast, this paper argues that landscape and topography has more than mere background significance in Zhang Yimou’s Riding Alone and that it functions as a “foreground” andan effective means of demonstrating national cultural characters. By combining western cinematic theories with traditional oriental landscape painting theories, the paper addresses seven different forms of the “foreground” role played by landscape: formal elements, emotional description, characterization, storytelling, multiple perspectives, ideology, and historical relevance.

The rise and maturity of virtual reality (VR) technology has brought unprecedented innovation to film and television productions. Based on the three important attributes of immersion, interaction and imagination, VR has already broken the frame barriers of traditional film and television in terms of visual experience and brought immersion to a new stage; meanwhile, the participation of a large number of interactive elements empowers the viewers control over the filmwatching process, thus enabling the viewers to explore the process like playing a game. This new way of image expression and information interaction has undoubtedly opened up a new world for the production and dissemination of scientific and educational films. With the help of VR technology, scientific and educational film emphasizing the spectacular visual effect can enhance sensory stimulation and achieve the effect of educational instruction by means of entertainment in a true sense. With the further integration of multisenses, multiscreen interaction, group networking and artificial intelligence, VR technology is shaping a new form of scientific and educational film.

Qi Poetry has received the most concern among studies of poetry in Han Dynasty from academic circles, and sparked the most debates as well. Nevertheless, problems haven’t been settled, be it the relationship between Qi Poetry and divination ideology, or the causes of the rise and fall of Qi Poetry, thus calling for further discussion. In fact, Qi Poetry had the most revolutionary spirit among the three schools of poetry in Han Dynasty. As a result of the internal drive by the revolutionary spirit, it took the lead in accepting the theory of YinYang and Five Elements and actively cooperating with Wang Mang’s New Reign. The fact that it was the first among the poetry schools in Han Dynasty that stepped out of the historical stage has something to do with the declining“revolutionary” spirit.

Take Collected Annotations to Wen Xuan: Jiang Wentong’s Miscellaneous Poems as an example, the research of its prefaces and annotations, different texts, the changes of titles, the multidimensional interpretation of Li Shan’s and other various annotations including the annotations of the lost literatures, not only has great significance in checking the accuracy of the source text and supplementing the historical literatures, but also sheds light on the artistic styles of the poetry in Han and Jin Dynasties and the process of their canonization. A comparison of the early handwritten copies and carving copies of Wen Xuan is conducive to tracing back to its original form and sorting out and revising the collections of middle ages or ancient times. Meanwhile, consideration should be taken into the inclusiveness and diversity of texts, as well as the cultural connotations underlying the text transformation. It is of great methodological significance to the study of ancient literatures if we attend to the text evolution and the generative mechanism behind it, make full usage of the annotated versions and review and reexamine the interactive relationships between texts, annotations and readers in a pluralistic and inclusive perspective.

For privateowned enterprises, excessive investment may restrain corporate technical progress and then worsen corporate overcapacity. But this mediating effect of technical progress does not exist in SOEs.Finally, due to the differences between overcapacity and undercapacity industries in supply and demand relations, the mediating effect of technical progress demonstrates"partial" mediating effect in overcapacity industries while "complete" effect in undercapacity industries.

Robots and artificial intelligence in a wider sense do not have a subject status in the current law. However, the subjects of civil law show the trend of expansion and there are no technological obstacles in empowering robots with legal status. The overseas discussion about robots’ subject qualification in the law diverges into two trends: objectivism and subjectivism. The objectivism includes the theory of product liability, the theory of analogizing the application of animal subject and other different theories. The subjectivism includes the theory of agency, the theory of electronic personality and other different demonstration methods. However, the objectivism cannot cope with the rapid development and the intellectualization of robots. Meanwhile, the subjectivism fails to take into account the reality that the artificial intelligence is yet to develop into fullblown. At present, the discussion of legal personality of robots in China should be based on the theory of the explanation of positive law and conform to the principle of “artificial intelligence as the object”. In addition, we can take artificial intelligence under specific circumstances as legal subjects by the legal technology of “fiction” so as to lay further legal foundation in the face of rapid development of artificial intelligence.

CISG is an important convention in the contract law of international sale of goods. To properly settle disputes, CISG has established a remedial mechanism, which consists of compensatory damages, specific performance and restitution. Although such a mechanism proves to be highly competent in a vast majority of cases, it indeed has some shortcomings under certain circumstances, especially when the observant party can hardly prove its loss and the default party benefits from a malicious breach of contract. The introduction of disgorgement of profits is necessary in that it can offset the weaknesses of CISG. Despite different understandings over disgorgement of profits, they will not affect the proper interpretation and application of CISG. From CISG’s perspective, there are two potential approaches to applying disgorgement of profits, namely, regarding disgorgement of profits as an alternative way of damages calculation, or as a new type of remedy based on the good faith principle.

The Puzzle of Concessive Knowledge Attributions in Ordinary Contexts: Interpretation and Solution

The intuitive inconsistency of concessive knowledge attributions (CKAs) has become one of the puzzles in epistemology and philosophy of language. This allegedly “sensed” inconsistency has also become a main argument by means of which contextualists attack invariantism and infallibilists criticize fallibilism over recent years. Nevertheless, by making a detailed analysis of the crux of CKAs and following the approaches of epistemic gradualism and pragmatic invariantism, we can prove that a knowledgeascribing sentence conveys the implicature that the ascriber is (partly) certain or that he/she can eliminate relevant alternatives, and such implicatures may be cancelled by a concessive clause. Further, the apparent inconsistency of this type of sentences may be explained away by either filling in degree indicators or interpreting “know” as loose use. The acceptability of CKAs has also found evidence in our recent experimental study.

In “Butterflies”, Ian McEwan depicts the entropic state of London in terms of energy loss and inadequacy of negative entropy. The presence of the “underground”, the return of Dionysian spirit and the deficiency of community performance construct an entropic city where desolation, uncanniness and isolation permeate London’s geographic space, the protagonist’s psychic space and the city’s socio-cultural space. Urban entropy reveals the conflicts between development and deterioration, between civilization and barbarism, and between empathy and distinction. It suggests Ian MacAbre’s skepticism about the notion of “linear progress” that is in accordance with the ethos of the Enlightenment, insinuates the vulnerability and uncertainties of the city, and reveals McEwan’s deep concern for the existential predicaments of marginalized subjects in the city.

It is a doubtful judgment that the level of SinoRussian economic and trade cooperation is disproportionate to the bilateral relations and trade potential. There are many logical problems in the existing methods for calculating trade potential, thus the SinoRussian trade potential estimated accordingly cannot accurately reflect the basic national conditions of the two countries. Based on the characteristics of resource endowments, the stages of economic growth and the dependence of economic development on open trade, there are some ceiling restrictions in the economic and trade cooperation between the two countries. These restrictions include the total volume of bilateral trade, its share of foreign trade in each other, the structure of economic output and the difference in the strategies for foreign economic relations. They not only determine the current level of SinoRussian economic and trade cooperation, but also the growth space in the future. The problems accumulated in the Russia's economic development and the future direction of its economic policies should be regarded as the basis in judging the future growth space of SinoRussian economic and trade cooperation. Large projects and energy cooperation, investment cooperation, financial cooperation and trade cooperation in intermediate products will be the major areas of future SinoRussian economic and trade cooperation and important directions for policy cooperation as well.

The expansion of U.S. dollar exterritorial jurisdiction has made numerous Chinese enterprises and financial institutions sanctioned for the violation of U.S. unilateral economic sanction laws and the Foreign Corruption Practices Act during the process of “going global”. Under the background of the U.S. expansion of extraterritorial jurisdiction over U.S. dollar transactions, “DeDollarization” is becoming a trend. As Renminbi has become one of the Special Drawing Rights (SDR) currencies of the International Monetary Fund (IMF), Renminbi is expected to play an increasingly important role in international settlements. Therefore, on one hand, we need to consider how to construct the supporting financial regulation systems during the process of the internationalization of Renminbi. On the other hand, as the conflicts of the interests between China and the United States and China’s coping tactics in response to “DeDollarization” pose new challenges to Chinese legislators and policy makers, research on the legislative and judicial practices of the United States’establishment of extraterritorial jurisdiction over U.S. dollar transactions will shed on reflections and enlightenments to improve Chinese financial regulatory legislations, which is of great practical significance.

Sense and Sensibility: Edward Yang’s Emotional Complexity and#br#  Author’s Presence:A Study of Edward Yang and His Films
Journal of Shanghai University (Social Science Edition)    2018, 35 (4): 34-43.

Edward Yang shows strong “author’s presence” in his films while addressing “sense and sensibility”, different from that in films like Springtime in a Small Town. His films demonstrate more of his personal conflicting “sense and sensibility”. As a typical type of intrusive writing, his works acquire the inclination to ruminate the author’s personal history, emotions, feelings and the like as well as an effect of “selfoxidation”. It is through this “wrapped slurry styled writing” that endows Yang’s films with distinctive brilliance.

“Magic Trick Films”and the Body Sensationalism of Early Cinema
Journal of Shanghai University (Social Science Edition)    2018, 35 (4): 43-52.
    Abstract622)            Save

European and American films of early period demonstrated distinctive “attractions”during the late 19th and early 20th century, and the magic trick films in particular, created effects of body sensationalism by illusions and tricks. The special visual effects such as stop trick and superimposition made “sudden morphs” on big screen; in the meantime various themes like exoticism, ghost, scifi and magic brought gothic sensational experience to early audiences. These changing tricks and illusions created by films became an important means of training the body senses, thus providing an effective channel and chance for the audiences of the early cinematic period to adapt to the fast changing urban modernity.

    Digital Capitalism: “Falsification” of Capital?
Journal of Shanghai University (Social Science Edition)    2018, 35 (4): 53-60.
    Abstract663)            Save

With the aid of network technology and digital information, digital capitalism has accomplished survival of digital existence as well as continuous accumulation and expansion of capital. On the surface, the production, circulation, distribution and consumption of capital and the acquisition of surplus value no longer depend on labor, but on information and technology. However, digital capitalism has concealed privatized mode of production in the name of “economic revolution”, concealed the true source of surplus value by holding high technology determinism, concealed exploitation through the value law of equivalent exchange, and concealed poverty and inequality in the form of capital accumulation. The fundamental factors defining capitalism have not  changed in digital capitalism. Neither have private ownership and the law of value. Therefore, digital capitalism is still in the domain of “critique of political economy” within Capital, without falsifying or negating it.
