    The Microcosmic Research on the Industrial Upgrading from the Perspective of New Structural Economics

     The researches on the industrial upgrading in the existing economics literature focus more on the macro level. Representative theories include unbalanced growth theory asserting that industrial upgrading is driven by demand and supply and new structural economics asserting that industrial upgrading is driven by the upgrading of endowment structure, which can be summarized as Engel Law, Baumohl Law and Lin Yifu Law. However, most researches on industrial upgrading have focused on the substitution effect and the income effect, without a thorough and holistic understanding of the practical process of industrial upgrading at the enterprise level. Most important of all, the dynamic core competence of an enterprise should be given a top priority, which in turn takes viability as a necessary condition, that is, the match of the resource endowment structure of the enterprise with its value chain structure. To conduct an in-depth research on the micro-industrial upgrading mechanism based on the viability of enterprises, we can draw strengths from both economics literature which lays more emphasis on theoretical mechanisms and management literature which is more practice-oriented, thus obtaining a better position to understand the world and conduct practice with guide.

    On the Narrative Rhetoric of  Chinese Opera Film

     Chinese opera (xiqu) film is a film art which adopts an opera-like narrative of images and actions. Camera editing of stage performances, close-up shots of singing, acting, recitation and acrobatics and spectacular visual effects of camera lenson stunt performances are  three special rhetorical devices in the narrative of Chinese opera films. Firstly, camera editing, mainly including connecting lens of different stages, putting together and editing lens of conflicting opera actions and shifting lens of virtual opera time and space, constitutes the fundamental means of making a Chinese opera film and endows it with dual narrative significance of film and Chinese drama. Secondly, close-up shots of singing, acting, recitation and acrobatics strengthen the effect of the procedural performance of Chinese opera by magnifying its fine details, clarifying its referents and in terms of its function, charisma and imagination adding a new dimension of “drama elements” to Chinese opera film. Thirdly, spectacular visual effects of camera lens demonstrate the enormous importance of technologies in the evolution of Chinese drama film as a new film genre, ranging from astonishing “stunts” unique in Chinese drama performance, to “illusory” spectacles of scenes and to the virtual “bullets” flying.  The “fusion” of the narrative rhetoric of Chinese opera art and that of film lens produces a larger effect than the combined effect of the two, and still more importantly, results in the most effective and aesthetically significant narrative rhetoric of Chinese opera film. Historical experience shows that the fusion of Chinese opera and film is not only an integration of two different art forms, but also a channel of art adaptation to the society and a way of survival. In this sense, Chinese opera film is the outcome of the self-revolution of arts as well as the adaptation of arts to social changes. How to effectively “apply” the narrative rhetoric of film to the narrative of Chinese operas with ethnic characteristics, and how to creatively give full play to the film narrative which is typical of modern industries while adhering to the opera narrative rhetoric,  is a pathway that Chinese opera film has to follow.

    Poetry-Film in China:A Comparative Study of the Convergence of Poetry and Cinema

    The film Legend of the Demon Cat is unique in the convergence and interaction of literature and cinema narrative. The cinema expressions of the poetic images in Bai Juyi’s “Song of Everlasting Sorrow” which is made as the background text, are able to transcend the narrative/poetic binary and lead us to the potential reinterpretation of the poetics of cinema. In modern poet Luo Fu’s same titled poem “Song of Everlasting Sorrow”, the frequently occurring images of lotuses in Bai’s version created in Tang Dynasty are replaced by the images of roses. This transformation signifies that the depiction of the Imperial Concubine Yang has changed from the traditional discourse system of Chinese poetics to that of contemporary poetics. In the film Legend of the Demon Cat, the images of lotuses and roses converge with each other, and the literary narrative of the “Song of Everlasting Sorrow” in the textual form and the non-narrative of the lens language of the film work together to achieve a poetic effect that breaks away the limit of carrier awareness. The coexistence further contributes to the breakdown of the demarcation between moral preaching and romantic narrative, returning to the poetry-film convergence of local visual thinking.

    Beyond Immanent and External Transcendence: Confucian Immanent Transcendence and Its Outcome

    To identify the trait of Confucianism with immanent transcendence is not a rare practice, which seeks to single out the unique feature of Chinese culture and especially Confucian culture from the contrastive perspective of Chinese and western cultures. However, with the popularity of China’s immanent transcendence and western external transcendence, it has been argued that theories of external transcendence also exist in China and statements of immanent  transcendence also find expressions in the West. Therefore, immanent and external transcendence are not sufficient to define the uniqueness of the two different cultures. Even if the assertion of immanent transcendence is made, its double-edged sword nature can not be neglected: it not simply highlights the characteristics and advantages of Chinese culture, but also leads to two serious interruptions: deities’ regulations and restrains on humans and the value of substances independent of humans. To connect the two interruptions, Confucianism must strive to achieve three breakthroughs. Only by doing so can Confucian and Chinese culture change its current disadvantaged position in the modern world, shed light on political governance, make itself better known to the outside world and regain its past glory.

    International Sanctions and Impediments to Contractual Performance

     Under the background of China-US trade war, many Chinese enterprises are sanctioned by the United States.Sanctions imposed on Chinese enterprises by the United States, from macroscopic perspective, have greatly harmed China’s state interests and Chinese enterprises’security of supply chains. From the microcosmic perspective, it is essential to come up solutions to the impediments to contractual performance caused by international sanctions. In international commercial transactions, how will it be identified under the governing law of a contract if a party cannot perform its contractual obligations due to the enforcement of sanction measures?How to allocate the risks of impediments to contractual performance caused by international sanctions between the two parties through prior arrangement of contract terms? How to deal with the impediments to contractual performance caused by international sanctions under Chinese legal framework? These issues are worth pondering. In view of this, based on categorization analysis, the article examines in a comparative perspective whether impediments to contractual performance caused by international sanctions constitute excuses for non-performance, discusses the differences in the application effects of those force majeure clauses, liability exemption clauses and compliance commitment clauses related to international sanctions that are widely applied in practice, and presents some ideas on how to deal with impediments to contractual performance caused by international sanctions under the framework of Chinese laws.

    The Prevention of White-Collar Financial Crimes in China#br# under Social Governance

     White-collar financial crimes are illegal behaviors committed in the financial sectors by executives, managers, technicians or other agencies of financial markets to seek illegal benefits by taking advantage of their positions, which pose serious harm to the financial order and the interests of other persons. At present, due to the limitations and the unique features of white-collar financial crimes which often involve complexity and professionals, Chinese criminal law is faced with many difficulties in the prevention and control of white-collar financial crimes. Since comprehensive social governance boasts multiple and all-round means, it has a clear advantage in the prevention of white-collar financial crimes while effectively containing the breeding of them. In view of this, the perspective of social governance is adopted to explore multiple approaches to the prevention and control white-collar crimes and relevant preventive measures are proposed.

    A Study on the Establishment of Labor Standards for Talent #br# Highland in China’s Free Trade Zones —A Perspective of Labor Rights Protection

    In the establishment of labor standards for talent highland in free trade zones, both international and domestic levels should be taken into account. At the international level, the provisions and standards in the International Labor Convention (ILO) together with US and EU free trade agreements (FTA) can be referenced to and selectively adapted for China's usage. At the domestic perspective, greater importance should be attached to the special demands of high-level talents and the institutional supply capacity of the state, because the former provides basic rules guaranteeing labor rights for international talents while the later reflects the national lawmaker's legislative will and institutional supply capacity. Specifically, it is essential to assimilate the essence of international labor standards, promote the convenience of talent flow and adopt flexible work schedules. In addition to implementing the international prevailing labor standards in the FTA, we should also play the role of both participant and leader in the process of formulating and revising the international labor system. Meanwhile, it is vital to realize the orderly flow of international and domestic talents and labors in those free trade zones with possible conditions while considering the actual needs of the zones and seeking for reference the detailed and practical provisions of US and EU FTA on the movement of natural persons. Finally, in terms of domestic legislation, it is necessary to make full use of the “local legislative power” and the method of legal interpretation so as to maximize the legislative power of free trade zones and achieve policy objectives.

    Big Data and Creatructive Epistemology

    The advancement of the new generation of artificial intelligence further demonstrates the important role of big data in a profound way. It is on the basis of big data that new epistemological purports have arisen from the process of information technology development.New epistemological purports have emerged one after another, from the “procedural epistemology” in the philosophical research of computer to “epistemology of the algorithm” in the philosophical research of intelligent algorithm. These purports are not identical with the epistemic ones oriented towards the existing natural world, but creatructive (creative-constructive) epistemology in contrast with descriptive epistemology.The purport of creatructive epistemology originates from the activity of self creatruction ( creation-construction), a concept of holistic construction of creating new things out of nothing. The creatructive activities based on big data show the development from understanding and changing the world to creatructing the world, which means not only an expansion from descriptive to creative cognition, but also an extension from descriptive to creatructive epistemology.

    The Modern Legacy of the Discourse of Simmel’s Philosophy of “Money”and Its Significance in the History of Thought—Based on Intertextuality Analysis of Marx’s Texts

    Money, an intermediary and symbol, is an important approach to understanding modern society. In the contemporary study of Marx’s critique of political economy, it is very important to introduce Simmel’s perspective to explain Marx’s monetary philosophy. However, the internal dimension of Simmel’s philosophy of money is often neglected in the past studies together with its effect on ideological history of Western Marxism. Marx’s philosophy of money is a materialist historical interpretation of the structural relations of money, ownership and modes of production within a critical theoretical paradigm. Comparatively speaking, Simmel’s analysis of money is more based on psychological experience and interactive exchange relations within a cultural and social theoretical paradigm. Simmel’s theory is a supplement to and an extension of Marx’s macro structure analysis and directly affects Lukacs’ interpretation of Marx’s philosophy. This provides new evidence for Lukacs’ source of thought, which is significant in the history of thought and enlightening to China’s current social construction .

    The Opposition and Unity of Secularity and Sacredness in Shakespeare’s Dramas

    The coexistence of secularity and sacredness constitutes a unique feature of Shakespeare’s dramas. Shakespeare’s dramas are reexamined in terms of public space, theatrical relationship, space-time art and world stage to explain how public space in drama can be integrated into commercial entertainment space and ritual space in performance, how the ritual characteristic in drama can be made use of to underscore audience and performers’ joint creation, how tangible characters can display their intangible spirit in the art of theatrical performance and the limited space-time can show the infinite space-time, and how drama as a comprehensive art can be made in a world stage to present a global perspective. It is concluded that Shakespeare’s works of art produced in the late Middle Ages and early modern times, such as the historical nodes of the Renaissance, the Reformation of the Religion, the rise of nation states, and the opening of new routes, demonstrate both unity and opposition of secularity and sacredness.

    Practice Focus, Theory Integration and Tradition Inheritance: Revisiting Community Aesthetics in Three Dimensions

    Community aesthetics, a new direction of film aesthetics, has three significant features. The first feature is the “focus on practice”, which means synchronously tracking the new development trends and new possibilities in the film industry, including the impact of the advancements and changes of social environments and cultural contexts on films, as well as how film technologies strongly influence, rewrite or even disrupt films, especially high technologies such as digital technology, cloud computing, artificial intelligence and big data. The second feature is “theory integration”, which means critically, creatively, constructively and integrally inheriting the valuable achievements in film theoretical researches and aesthetic theoretical researches. The third feature is “tradition inheritance”, which is not only the inheritance and transformation of Chinese traditional cultural thinking, but also the product of spiritual inter-connectivity with the global film industry. Therefore, community aesthetics has the potential to provide a theoretical method, a framework, and a model, capable of exploring inclusive, interactive and practice-oriented theoretical space, theoretical tension and theoretical height.

    What is Meant by “Community”? —Theoretical Support and Question Awareness of Chinese Film Community Aesthetics

    “Community”, a means of satisfying individual needs, aims to enhance harmony  and peace among its members and organizational stability and acquires the traits of romantic ideals. The proposal of such an inclusive concept enables people to constantly reconstruct “community” by embedding it into new contexts, which has laid basis for our attempt to build connections between “community” and film aesthetics. Meanwhile, aesthetics of traditional Chinese art, including aesthetic thoughts on Chinese film theory, has always put emphasis on the importance of image text and its relationship with art types. In addition, Chinese film aesthetics emphasizes sensual pleasure, which can hardly be detached from ethical social emotions. In fact, we have failed to apply the community nature of Chinese film aesthetics to actual film shooting. However, this is the question awareness we should hold in exploring Chinese film community aesthetics. Still more importantly, we should seek solutions to current Chinese film predicaments from Chinese film community aesthetics.

    Community aesthetics, a reflection of aesthetic emphasis on community vision, is not monolithic, but multi-dimensional in social, national and humanity respects. These dimensions are not only reflected in the development trend of domestic films in recent years, but also present complicated hierarchy and relationships inside community aesthetics. Although the films primarily featuring the vision of national community are dedicated to individual-state connections through community aesthetics, the triggering effect of social empathy plays a decisive role. On the other hand, although the films emphasizing the vision of social community can arouse the audience’s empathy by presenting images of social problems, they are often in tensions with the vision of national community. For those films with global community of shared future as the central theme which are a new trend of community aesthetics, despite their success in employing Chinese experience to tell the grand narrative of the shared future of mankind in good coordination with the vision of the national community, weak links with the vision of social community have been inadvertently exposed. Therefore, how to coordinate multidimensional visions within the community aesthetics so as to achieve the greatest cohesion is still a direction deserving great consideration nowadays in advancing community aesthetics.

    Labor as Way Out—A Historical Study on the Issue of Mobilizing Primary andSecondary School Graduates for Agricultural Production in the Early Period of PRC

    The People’s Daily published an editorial entitled “On the Issue of the Participation of Primary and Secondary School Graduates in Agricultural Production” on April 8, 1957. It pointed out that in 1957, only a small portion of high level primary school students (grade 5 and grade 6 students) and junior high school graduates could be admitted to a school of higher level while the vast majority were rejected. The main way out for the rejected was to participate in agricultural production in the countryside, which aroused widespread concern and discussion from all works of life. Taking the editorial as the departure of discussion, the paper attempts to present the historical and practical course of the CPC’s dedication in general education in primary and secondary schools and their adaptation to the needs of national governance in the early period of People’s Republic of China (PRC) by discussing the issue of mobilizing primary and secondary school graduates to participate in agricultural production in 1957. A prevalent view at the time held that the participation of primary and secondary school graduates in agricultural labor was an important issue on the agenda of “fostering the first generation of educated farmers in New China”. In view of this, how to make an epochal response to labor, especially manual labor, becomes the key to understanding this historical issue.

    The “Emergence and Flow” Mechanismof Rural Cadre Group Development in the Early 1950s—An Investigation of Farmers Associations

     In the early 1950s, severe shortage of rural cadres was a common problem in the establishment of local governments in newly liberated areas of Southern China, which even posed impediments to their normal operation. Farmer representative conferences and farmers associations, which gradually came into being in the movements of grain requisition, rent and deposit reduction and land reform, created opportunities for new rural cadres to emerge in large number. Organizing farmers to “vent their grievances” at these meetings became an important means of mobilizing farmers to change their mindset of “fatalism”or “restoration of reactionary rule”. It was during this process of grievance venting that active participants were transformed into the backbones of farmers associations. Due to the rash decision at the early stage of farmers associations, some leading positions of the associations were often occupied by those whose class status and moral quality were flawed. With the advancement of such movements as rent and deposit reduction and the land reform, personnel replacement was launched.Seizing the momentum, the newly booming enthusiasts who were usually poor farmers or farmer laborers replaced those flawed,thus presenting a clear picture of rural cadre flow. In this process, a close coupling between governmental means of movements and theories of class struggle eventually prompted the “emergence and flow” mechanism of rural cadre group development in this period, laying an important foundation for the power transfer to the new regime in the rural society.

    An Empirical Study of the Impact of the Belt and Road Initiative on the Debt Problems in Countries along the Road

    The Belt and Road Initiative has made remarkable progress since 2013 as more and more countries have been joining in the effort to build a mutually beneficial global economic system. However, in order to protect their own status and benefits, some countries deliberately spread rumors that China seizes the opportunity to push a “debt trap”. Such rumors pose obstacles to the development of the Initiative. In view of this, the overall debt situation of the countries along the belt and road is studied with important indexes such as GDP, export of goods and services and stock of foreign debt of some countries along the route.The changes of liability ratio, foreign debt ratio and growth rate before and after the implementation of Belt and Road Initiative have been compared, followed by a econometric model to examine the specific impact of the Belt and Road Initiative on the stock of foreign debt and liability ratio of the countries along the route. It is concluded that although the stock of foreign debt has significantly increased under the Initiative, which means increased debt burden and existing debt problems of some countries, the impact of the initiative on liability ratio and growth rate of the countries along route is significantly negative, which means risk reduction of their debt. To sum up, the accusation of China of setting up “debt trap”is groundless since the results show China is not the main cause of their debt problems, nor has them fallen into a “debt trap”.

    Developing China’s Aging Industry and Defining Government Functions

    Throughout the development course of China's aging industry, the Government has held a clear and steady attitude towards the issue of elderly care and continuously adjusted its intervention in the issue from sole government responsibility to the shared responsibility by all sides of the society, from an athlete role to a dual role of both athlete and referee. This is the fundamental requirement of socialism with Chinese characteristics, and determined by the particularity and importance of pension activities. However, problems still exist such as an incomplete pension system, inadequate policy measures, and unclear government and market functions. The pension security system should be further improved to clarify the boundary between government and market functions.

    Praxis and Limitations of Intersectionality in the US

     The death of George Floyd has triggered the resurgence of discussion on racism. Yet we should not simply interpret this incident  as a racial issue, but simultaneously examine the resulted Black Lives Matter(BLM)movement in a holistic manner. Different from traditional civil rights movement in the past, the BLM movement is fundamentally a kind of identity politics led by “intersectionality”.In response to people’s challenge to the narrow group consciousness of identity politics, black feminists proposed the theory of intersectionality to integrate multiple identities to strengthen resistance.However, intersectionality has also encountered many problems in praxis. Because it fails to transcend identity politics’ mistake in disregarding economic issues, it remains essentially a reformist plan of capitalism,unable to effectively aggregate forces against capitalism. This enlightens us that new social changes should return to  the perspective of Marxist theory in the pursuit of eliminating the capitalist system.

    British Literature and Its Narrative Construction of National Identity

    National identity is the collective identity of a nation, and it is the reproduction and reinterpretation by the members of a nation of its peculiar values, myth patterns, symbol systems and cultural traditions. Literature is the crystallization of national culture, and its production narrates and constructs the development of national identity in history. The literary works of different periods in the UK history narrate, copy and inherit the characteristics of its national identity. The Anglo-Saxon literature, the Renaissance, and the 17th century literature in the early English literature precisely represent the evolving Englishness in the national identity. The diversity of English literature, Scottish literature and Irish literature since the 18th century have constructed the characteristics of Britishness in national identity. The rise of Minority literature in the 20th century has expanded the narrative styles of British literature and parallelly constructed the cosmopolitan characteristics of British national identity.

     Over the past 100 years, the Communist Party of China (CPC) has won great victories in revolution, construction, reform and opening up, etc.. Its important secret lies in the possession of a grand cadre team that have firmly implemented the Party’s lines, principles and policies over the century, while the success of this team lies in an effective cadre selection and appointment system. Looking back at the centenary evolution of the system, it is not hard to summarize some valuable experience of CPC in the long-term practice of cadre selection and appointment: adhering to the CPC leadership over cadres, emphasizing both political competence and professional expertise, strengthening both democratic selection and performance orientation, and highlighting the selection and cultivation of young cadres. Looking ahead, the Party needs to further expand visions, stick to performance standards, select and appoint cadres on the scientific basis, clear the road for the growth of outstanding young cadres, and make use of talents pulled from all over the world.

     After the disintegration of the old imperial system, the historical mission for China was externally resisting foreign aggression, and internally unifying political powers so as to achieve national independence and prosperity. History finally chose the Communist Party of China (CPC) to lead the Chinese people on the road of building a modern socialist country with Chinese characteristics. As the explorer and leader of Chinese modernization drive, the CPC has constantly readjusted the goals for the big question of “what kind of country to build” over the past 100 years. The goals have evolved from vagueness to clarity, from vision to reality, from pilot reform to final model, and from deepening reform to breakthrough success.     Interaction between History and Literature and Arts: Rereading Revolutionary Film Critic Jia Ji#br# #br#

     Film critic Jia Ji’s literary and artistic activities can be divided into three stages: engagement with drama before 1949, film criticism and creations during the “Seventeen Years” (1949-1966) and film criticism and education in the new period starting from 1976. Through long-term revolutionary work, Jia gradually formed the thought of “literature and art serving politics”, which was strengthened by his criticism of the film The Legend of Wu Xun. However, in the new period, Jia abandoned the mindset of film criticism centering on “serving politics”. Rather, he began to rethink the role of film as an artistic expression. Jia’s thought on arts and literature reflects the mainstream value of the times and the spectrum of literary thought. In assessing the status and role of Jia’s thought on arts and literature, we need to adopt a dual historical perspective: considering both the specific context of the times and the responses to the questions at the time.

    Negotiating Modernity: Observations on MP&GI’s Family Melodramas

     MP&GI was one of the most important film production companies in  Hong Kong after World War II. Centering on such issues as family and marriage, the family melodramas produced by MP&GI were influenced by both early Chinese cinema and Hollywood, reflecting the changing values of the middle class after the war. This genre affirmed positive factors of traditional Chinese ethics, meanwhile stressing the universality of modern values. Through different women characters, MP&GI’s family melodramas reflected the negotiation between modern and tradition, thus projecting the cultural traits of Hong Kong mandarin cinema in the 1950s-60s against the Cold War context.

    Generating New Characters of Silver Screen: #br# Reinterpreting Li Shuangshuang#br#

     Li Shuangshuang, the selfless, beautiful and candid heroine of the film Li Shuangshuang, became a representative of new characters produced during the initial socialist period of China. In the film, Li Shuangshuang’s political consciousness is spontaneously integrated into farmers’ daily life and works in coordination with folk justice and common senses. Thus, in generating such a new character, traditional moral ethics, emotional structures and life experience in rural areas all play an important part. Under the pen of the screenwriter Li Zhun, Li Shuangshuang is depicted as courageous to fight and “generous to forgive”, an ideal type with new socialist subjectivity. Xiwang, on the other hand, represents an image of most farmers in the agricultural cooperative movements. Through the storyline of “getting married first and then falling in love”, Xiwang gradually turns to be a subject more in line with the requirements of the agricultural cooperative movement. In the marriage with Xiwang, Shuangshuang is depicted as a more equal partner compared with a traditional wife image. In the generation of the new characters with socialist subjectivity, certain tensions between the screenwriter, director, and performers arise, so do dialogues and conflicts between Shanghai and Yan’an film style.

    Reviewing EVFTA in the Perspective of EU Highlighting Relationship with ASEAN and Its Implications for China#br# #br#

    The EU-Vietnam Free Trade Agreement (EVFTA) came into effect on August 1st, 2020. EVFTA covers dozens of topics with a series of new and high-standard international economic and trade investment rules, following a Pan-European FTA text model, creatively adopting Pan-European “three-track” rules of origin, further reforming the “P-G” and “G-G” dispute resolution mechanism, etc.. In contrast, China is gradually establishing a global-oriented FTA system in a holistic and comprehensive direction and confronted with such problems as more generalized or simplified rules, more conservative and traditional text clauses, and lack of creativity or breakthroughs in system design when signing bilateral FTA with other countries. At this stage, it is essential to refer to and learn from the useful experience and reasonable components of EVFTA, meanwhile integrating with the experience of China’s FTA development in the past 20 years. It is essential to implement precise policies on FTA under different levels of economic development, flexibly choose the “dual-track” certificates of origin, to improve the legal system of labor protection, establish an environment and trade coordination mechanism as well as a dispute resolution mechanism based on “soft law”, and actively promote the construction of a high-standard Chinese FTA network system so as to effectively promote the “Belt and Road” international cooperation and actively participate in the formulation and guidance of international economic and trade investment rules. It is time to link closely with the latest comprehensive and high-standard international economic and trade rules, strengthen the rational layout of network development and design strategies in global, regional and bilateral free trade zones, ensure a stable and flexible FTA “paradigm” so as to promote the construction of free trade zones. In so doing, we may confront the challenges from current international trade and investment with a more mature Chinese free trade zone system.

     Neighbouring right, an important part of the generalized copyright architecture, can be traced back to the Roman law era. Due to its statutory status and diverse types, neighbouring right has attracted the  academic attention from the very beginning. However, there has been neither consensus among scholars on its origin and essence, nor responses from China’s copyright legislation. The existing theory of the copyright law has failed to fully explore the normative significance of the neighboring right system due to the lack of systematic guidance of law doctrine, thus subjected to criticism. In view of this, the origin and essence of neighboring right is discussed and the common normative effect on all kinds of neighbouring rights is explored and emphasized. In so doing, we aim to better grasp the similarities and differences between the neighboring right and the copyright in the narrow sense, seek the value guidance within the limit of the expansion of the neighbouring right, and supplement and perfect the theoretical system of the copyright law.

    The Judgment of Taste and the Inevitable #br# Application of Its Four Moments#br# #br#

    The general form of the Judgment of Taste is “something is beautiful”. This is a priori synthetic judgment, which lays foundation for Kant’s analytic and deduction of the Judgment of Taste. Why and whether it is necessary to use the Four Moments to analyze the Judgment of Taste is controversial. “The First Critique” can shed light, but the Judgment of Taste is different from logically determining judgments, thus not suitable to be treated as a judgment that occurs linguistically (whether spoken or not) either from the angle of practical experience or from the perspective of strict logic, nor suitable to be simply analyzed formally or semantically. Moreover, what Judgment of Taste really judges and asserts is not to declare something is beautiful. Rather, it is a general form of judgment abstracted from our reflection on the aesthetic appreciation activity itself and the representation of both the reflection and the concept of Judgment of Taste itself. Because the elements constituting this form of judgment represent the characteristics of all aspects of Judgment of Taste, what the Four Moments illustrate are the characteristics of the Judgment of Taste. The Four Moments of Judgment of Taste are to take the appreciation activity itself as the cognitive object and analyze its concept, from which we can see the application of the Four Moments is inevitable.

    Research on the Knowledge Genealogy of “Art Management” from the Perspective of Social Transformation

The latter focuses on historical retrospection, aiming to clarify the historical causes of its rise and the theoretical basis of its development. “Knowledge genealogy” is not only a system description, but also a research method, committed to the unity of “logical research” and “historical research”. The rise and development of any discipline is bound to be subject to the specific backgrounds of the times. The worldwide “social transformation” that has gained momentum since the 20th century and not yet been completed up till now, not only has exerted strong influence on the past and the present of the discipline of “art management”, but also will profoundly affect its future development trend.

    China’s Smart Elderly Care Policy Based on Content Analysis#br# #br#

     Since the 13th Five-Year Plan, China’s elderly care services have made all-round progress. However, the “digital divide” between the ever-changing technological innovation and the continuous growth of the aging population is widening. In view of this, we focus on the “digital divide” by taking the Implementation Plan for Practically Solving the Difficulties of the Elderly in Using Intelligent Technology as the sample for analysis, adopting the content analysis method and setting policy tools and the varying needs of the elderly as the analysis dimensions. The results show quantitative differences in the distribution of policy tools, differentiation in specific combinations and matching and imbalanced proportion of meeting the needs of the elderly, which deviates from meeting the lower levels of needs from higher levels. Therefore, future policies should adjust the structure of policy tools and optimize their detailed distribution so as to meet the elderly needs of different levels.

    Pragmatic Translation Studies with Chinese Characteristics in an Era of Great Change: Status Quo and Trends#br# #br#

     Pragmatic Translation Studies (PTS) is an important branch of the discipline of Translation Studies. In an era of great change, PTS in China, with expanding research connotation and scope, more diversified research methods and increasingly salient features of interdisciplinary integration, has acquired a theoretical and practical significance unprecedented in the development of Translation Studies. However, a consensus is yet to be reached among the academia concerning the understanding of PTS. In view of this and based on the method of symptom reading and a descriptive approach, this paper reviews the present situation of PTS in China, not only identifying and analyzing its existing problems, but also clarifying its objectives and trends. PTS in China, with a self-consistent development logic rooted in China’s social, cultural and historical traditions, has developed into four dimensions of research: stylistic or typological studies, studies of pragmatic translation issues, theoretically based applied translation studies and studies of PTS discourse system. Additionally, PTS in China should meet the requirements of the era of globalization, technicalization and informationization with stronger awareness of serving the nation’s development strategies, so as to make due contributions in its trends such as translating Chinese cultures, forming Chinese knowledge discourse and integrating technologies and translation.

    The Origin and Development of Maritime Legal Order: Historical Context, Legal Dilemma and Maritime Legal Right

    Maritime legal order and the laws of the sea are within the same realm, but not in sync of development in a sense. In terms of space-time sequence and maritime-related norms, the origin and development of the maritime legal order has generally gone through the first, second and third stage of legal order. The rule of its formation and development trend can be examined in the perspective of social system dynamics, an important reference system for judging whether a country is a maritime power. A central realm in the generation of maritime legal order lies in sensible interpretation of the evolution of maritime legal rights in response to the legal dilemma involved. Our quantitative analysis of the laws of the sea strongly supports the rational basis for reshaping the core meaning of the maritime legal right in the new era, and in the meantime, briefly illustrates China’s vision of a maritime community with a shared future.

    On Trial-centralism: Underlying Logic of #br# China’s Criminal Judicial Reform#br#

    With regard to fact-finding, dossier transfer system, pretrial procedure and trial-centralism are functionally related. Since the three aspects are overlapping in functions and successive in terms of procedure, “substantial dossier reading + necessary pretrial meeting + superficial trial” becomes the structure of fact-finding, leading to the dissolution of the trial-centralism. The vertical linear structure or administrative structure of criminal procedure characterized by judicial integration has no functional requirements for the procedural justification of fact-finding, thus becoming the fundamental reason to dissolve trial-centralism. Therefore, China’s criminal procedure calls for two transformations in the span of three stages: shifting from administrative structure to judicial structure and from inquisitorial system to adversary system. Only by doing this can we realize trial-centralism or defendant-centralism in the real sense and solve a series of problems from technology to concept that have long plagued China’s criminal procedure.

    The Modernity Turn of the Legendary Narrative of Chinese Films since the New Period

     Legend is a holistic narrative paradigm of various genres in ancient Chinese literature, which is also inherited in Chinese films. In the early Chinese films, old-style ethics and aesthetics were the distinct characteristics of legendary narratives. However, since the new period of reform and opening-up, the pre-modernity narrative paradigm has acquired obvious modernity characteristics in terms of aesthetic and ideographic expressions with changing historical contexts. It is essential to combine the contexts of ideological history and cultural history to examine how the legendary narrative of Chinese contemporary films has evolved along with Chinese narrative poetics which has always attached importance to historical writing, and to explore some modernity symptoms from this evolution.

     Though both translated into Chinese expressions with the character of “后”, “Post Theory” and “post-cinema” in film studies and “post structuralism” and “After Theory” in literary theories are fundamentally different in that they have unique research questions and topics for discussions. ?i?ek’s criticism of the “Post Theory” on the basis of concept clarification, has a particular ideological significance in the transitional era. In the decline of Cultural Studies, ?i?ek’s re-symbolization and cognitive research of post theories constitute alternating theoretical choices for the production of humanistic knowledge in the wake of the “sokal-text” event.In the current “Post-cinema” state, the continuous development of Cultural Studies and the steady advancement of film philosophy present new opportunities and challenges to the studies of humanities in the development of new liberal arts.

    Dilemma in Urban Community Governance: Unbalanced Rights and Obligations #br# —Reflection on a Field Investigation of Shanghai Communities

     The relationship between rights and obligations is an important perspective to examine the construction and conservation of human society. Viewing urban community governance from this perspective, we may easily find that both the notion of “the People’s City” and the goal of building a social governance community are identified with the concept of “residents’ obligations preceding residents’ rights ”. Given the dilemma of urban community governance that “while China’s urban residents are enjoying increasing services (rights) in communities, their due responsibilities and obligations as community masters are continuously degrading, even disappearing”, the critical approach to this problem lies in constructing a community governance mode in which residents’ rights and obligations are comparatively balanced. Based on a field investigation in communities of Shanghai and using the mobile observation method and fixed-point observation method, we find that over-administration of the neighborhood committees, low-level operation of residents’ self-governance and weakening sense of community are the leading causes of residents’ unbalanced rights and obligations. In the future, sustainable development of Chinese urban community governance shall not only rely on appropriate intervention and policy support from government bodies, but also on residents’ self-governance combining both responsibilities and obligations and on the building of a governance community where “everyone is responsible, conscientious and rewarded”.

     With the rapid development of garbage classification in China, social organizations have drawn wide attention due to their important role in effective management of community garbage classification. However, there is still a lack of in-depth disclosure and induction on how social organizations carry out community waste classification. Combined with policy intervention and community type, an analysis framework of how social organizations select action strategies is constructed. We take the IFINE Environmental as a case study, track its involvement in four different community types, and then analyze its action strategies and selection logic accordingly. The results show that: a) compared with the government issuing mandatory orders, social organizations are more resilient and flexible in adjusting action strategies of community mobilization to different situations, thus effectively guiding community residents to carry out garbage classification; b) the action strategies of participating social organizations go through the changes in content and  way of participation from persuasion, participation, empowerment to authorization; 3) the action strategies of participating social organizations are variable and influenced by both policy intervention and concrete situations.

     Based on historical changes and temporal sequence, the evolution process of factor endowment change and industrial upgrading of navel oranges in southern Jiangxi province are analyzed in three stages. Following the grounded theory, the paper analyzes the driving forces behind the change of factor endowment and industrial upgrading in terms of “market efficiency” and “government facilitation”, with an emphasis on government facilitation of industrial development. It is found that the upgrading of navel orange industry in southern Jiangxi has experienced from agricultural self-sufficiency to initial industrial prosperity, and finally to the integrated development of primary, secondary and tertiary industries. The development mode of navel orange industry in southern Jiangxi can lend service to a path of characteristic agricultural development.

    Enterprise Social Media Utilization under the Circumstance of the COVID 19—A Study on the Moderating Effect of Public Social Media

    Encountered by the COVID-19, domestic firms have utilized enterprise information platforms as social media outlets to conduct epidemic prevention, information exchanges, organization coordination, work operations and so on. Enterprise social media (ESM) has demonstrated unique advantages and played a significant role in running organizational production and operation. However, a lower level of employee motivation and participation is a problem that has caused a reduced effect of ESM. The current studies have presented limited findings on such issues as what is the status quo of employee utilization, what motivates the utilization of ESM, and how public social media experience (PSME) exerts moderating effects on ESM, and empirical quantification analyses are expected. Based on the Utilization and Gratification Theory (UGT), the authors propose and verify a model on the relationships among the degree of ESM utilization, ESM utilization motivation and the degree of PSME through the structural equation modeling (SEM). The results demonstrate that information sharing and self-documentation are the two motives for employee ESM utilization; and positive moderating effects of the PSME on the relationships between information sharing and ESM utilization and between self-documentation and ESM utilization start to work unless the PSME is up to a middle or even a higher level. Moreover, the analysis through the Johnson-Neyman method presents quantitative outcomes, clarifying a significant range of the moderating effects of PSME on ESM utilization. The research is conducive to a better understanding of the working mechanism among ESM utilization, ESM utilization motivation and PSME, and provides domestic firms with necessary references for making decisions on information management.

     Based on conservation of resources theory and cognitive evaluation theory of stress, the influence of polychronicity on employees’ time banditry behavior is discussed and the moderating effect of challenge stressor appraisal and hindrance stressor appraisal is explored. Through the analysis of 323 valid samples, the results show polychronicity has a positive impact on employees’ time banditry behavior; perceived overqualification partially mediates the relationship between polychronicity and time banditry behavior; the relationship between perceived overqualification and time banditry behavior is respectively moderated by challenge stressor appraisal and hindrance stressor appraisal negatively and positively; and the mediating effect of polychronicity on employees’ time banditry behavior is negatively moderated by the challenge stressor appraisal and positively moderated by the hindrance stressor appraisal.
