    On the Legal Governance of Digital Ethics

    The fundamental values of offline and digital societies are aligned. Ethical risks in the digital society ultimately stem from the violation of universal ethics that respect equality and freedom of personality. If the guiding role of basic ethics is neglected, digital jurisprudence will lack a legitimate foundation; without the safeguard of legal institutions, digital ethics cannot be effectively implemented. Based on the incommensurability of personality and property, the legitimate externalization of the property value of personal information constitutes the premise of data rights determination. Under this premise, data rights should not blindly adhere to the ideal state of predetermined ownership. Instead, a system should be established that comprehensively considers respecting the labor contributions of data processors, improving data utilization efficiency, and balancing justice in data benefit distribution, thereby establishing a more refined system for data rights determination. To regulate the risks associated with digital technology applications, “beneficence”should be incorporated into legislative purposes, along with ensuring that the means of applying digital technologies are “trustworthy.”This means developers or applicators must disclose and explain their algorithms and potential impacts on the rights and interests of relevant subjects. The essence of digital social ethics ultimately lies in natural humanity, and the rule of law in digital ethics aims to cultivate humanity’s capacity for the pursuit of the good.

    On the Nature of the Company: An Analysis from Semantics to Function

    The company is merely a form of organization; it is not necessarily a for-profit legal entity, nor does it invariably imply limited liability for its investors. China could draw upon UK legislative experience to diversify its corporate forms by permitting the establishment of charitable companies, community interest companies, and other varieties. From an economic perspective, a company is“a nexus of contracts”composed of express and implied contracts that define rights and obligations among various participants, with the aim of internalizing transaction costs. However, the separation of ownership and control generates agency costs. To address the problem, the institutional design of corporate law and the establishment of mandatory rules should be benchmarked against the necessity of reducing these agency costs. There is no necessity to constrict the scope of authority delegated by the shareholders’meeting, nor is it appropriate to transform the enabling rules regarding the appointment of directors into mandatory legal norms. Common law jurisdictions, adapting to the evolution of commercial activities, have refrained from providing a precise definition of“the company”to avoid self-imposed limitations that might shackle the development of commercial organizations. Similarly, China’s Company Law only delineates the scope of its application without strictly defining the concept of the company itself, a stance that serves as a strong embodiment of scientific legislation. Limited liability, acting as the cornerstone of the modern corporation, has had its utility specifically demonstrated within economic theory.

    An Analysis of the Fundamental Principles of Foreign-Related Rule of Law

    The strategic planning for the foreign-related rule of law, along with the mandate to synergistically advance both domestic and foreign-related rule of law, sets forth clearer objectives and more meticulous requirements for all areas of legal practice, aspects of legal scholarship, and components of legal education. To achieve these objectives, it is essential to define the fundamental principles of foreign-related rule of law, which serve as high-level precepts and a guiding philosophy. In the current context, the development of foreign-related rule of law must uphold the Party’s leadership as its foundational soul, adhere to a people-centered approach to meet people’s aspirations for a better life, construct a framework for a dynamic balance between security and development, create a paradigm that appropriately integrates cooperation and struggle, and promote an organic synergy between the overall domestic and international situations. In the planning and implementation of all work, these principles must be established as legislative guidelines. They should permeate all subjects and stages of foreign-related legal activities, serve as the basis for interpreting relevant laws and regulations, be applied to address legal loopholes, enrich legal theory and knowledge systems, and guide participation in global governance and adherence to the international rule of law. The implementation of these principles will effectively safeguard national sovereignty, security, and development interests, contributing to the building of a community with a shared future for humanity.

From the Wan brothers’experiments in localizing celluloid animation to the contemporary advancements in Artificial Intelligence Generated Content (AIGC)-powered intelligent creation, Chinese animators have constructed a unique animation language system through the dialectical development of“learning from foreign strengths”and“upholding cultural integrity.”Throughout this century- spanning journey, Chinese animation has advanced under the dual impetus of“instrumental rationality”and “value rationality.”While technological innovation has shaped national aesthetics, cultural subjectivity faces new challenges in the realm of digital simulacra. In the era of digital intelligence, maintaining creative autonomy and cultural roots has become a core issue for the future of Chinese animation. This article, from the perspective of media archaeology, reveals the cultural logic behind these technological iterations and offers insights into constructing a new animation paradigm for the modern era that combines technological autonomy with cultural subjectivity.

    From Secondary Text to Composite Text: Re-examining the Genre Boundaries and Cultural Attributes of Contemporary Film Posters

    Within the genealogy of visual communication media, film poster holds a unique position defined by its distinct textual attributes and functions. Traditionally, the film poster functioned as a secondary text. Its creation involved using graphic design to construct a cross-media signifying system, which took the film proper as its primary text and the poster as its vehicle. However, with the maturation of the digital communication ecosystem, visual communication has evolved into a symbiotic cross-media modality characterized by topic-centered aggregation, multi-platform dissemination, and online-offline synergy. Situated within this new ecosystem, the film poster is undergoing a significant transformation in both its production methods and textual form. Drawing upon a dual frame of reference—the historical trajectory of the film poster and the evolution of media technology—we argue that the contemporary film poster is increasingly taking on the form of a composite text, integrating multi-agent collaboration, multimedia convergence, multi- functional consolidation, and expressive diversity. Its objective is to create an open discursive space with complex cultural functions that can effectively convey film information by leveraging visual perception and shared topics as a nexus to actively incorporate audience participation.

    Cognitive Colonization by Generative Search Engines: Governance Recommendations

    Generative search engines shift the way humans access information from the traditional retrieval-filtering approach to a“Q&A-generation”model. This will not only bring about a transformation in Internet infrastructure and the human cognitive paradigm but also cause users to slide along the cognitive track laid down by algorithms, potentially succumbing to cognitive colonization. This type of cognitive“outsourcing” is likely to lead to“thinking alienation”or even“cognitive alienation.”Generative search engines utilize Large Language Models (LLMs) as mediators to generate answers. However, the inherent defects of LLMs—such as “poisoned”training data and“model hallucinations”—will aggravate information pollution, homogenize information sources, proliferate misinformation, damage the information ecology, and lead to fragmented infringement. Consequently, answers generated by large models are not always objective or trustworthy, and knowledge colonization can, in turn, exacerbate security and ethical risks. To mitigate these risks, beyond establishing higher ethical requirements for enterprises and users, it is essential to build an integrated governance model encompassing four dimensions: technology, institutions, the market, and human values. This will ensure that generative search engines become the Promethean fire of human cognition, rather than a new form of cave captivity.

    The Construction of Embodied AI Bodies

    Embodiment in Artificial Intelligence (AI) fundamentally differs from human embodied cognition. Human cognition is grounded in the sensory-motor system of a biological body, forming a holistic entity that integrates consciousness, emotion, and action. In contrast, machine embodiment is achieved through the functional coupling of a physical carrier and an algorithmic model. A comparative analysis reveals that while AI cannot replicate the biological properties inherent to human cognition, it can simulate a functional“mind- body relationship”by creating an artificial perception-action loop. Nevertheless, the construction of effective machine bodies faces three primary challenges: morphological complexity, control complexity, and evolvability. Future research should therefore focus on resolving these fundamental issues by investigating the balanced interaction among the machine’s body, its information processing system, and the external environment to chart a clear path forward for machine-body engineering.

    Common prosperity is a global challenge that hinges on the organic unity of growth and sharing,as well as fairness and efficiency. This article proposes a theory of“empowering common prosperity”with Chinese characteristics, which centers on impartially empowering economic entities with development opportunities and capabilities. This theoretical framework operates at three levels: First, income growth and distribution gaps, though widely discussed, are merely surface-level outcomes. Second, the vertical growth and horizontal distribution of human capital act as intermediate drivers determining the level and evolution of common prosperity. Third, high-quality and inclusive public services that foster conditions for human capital development constitute the underlying foundation. Such services exert a dual effect: increasing the aggregate value of societal human capital and optimizing its distribution. Furthermore, this study constructs a quantitative evaluation system for empowering common prosperity by leveraging high-fidelity big data and integrating methods such as machine learning and trajectory analysis.

    Manufacturing Digital Intelligence, Industrial Scale, and Global Value Chain Position — A Study on Developing Countries

    The development of digital and intelligent technologies has profoundly reshaped the Global Value Chain (GVC) positions of manufacturing industries across countries. This study investigates the role of industrial scale in this process, integrating industrial competitiveness analysis with GVC theory. Building on the GVC location configuration model as the theoretical foundation, the research employs OECD ICIO database data from 39 developing countries across 17 manufacturing sectors. By distinguishing between intermediate and final products, the empirical analysis reveals that digital and intelligent inputs significantly influence developing countries’GVC positions. Industrial scale exerts a moderating effect through two channels: improvement in total factor productivity and reduction in trade costs. Specifically, the scale of intermediate goods production (production-side) amplifies the positive impact of digital and intelligent inputs on intermediate product GVC positions, while the scale of final goods consumption (consumption-side) weakens the negative effect of digital and intelligent inputs on final product GVC positions. This study provides theoretical insights for developing countries to enhance their GVC positions amid digital innovation-driven growth paradigms.

    The Impact of BRI on the Financing Structure of Chinese Enterprises

    The Fourth Plenary Session of the 20th Central Committee of the Communist Party of China has explicitly emphasized the high-quality joint development of the“Belt and Road Initiative”(BRI). Against the backdrop of profound adjustments in the global economic landscape and rising external uncertainties, the 15th Five-Year Plan period presents both risks and opportunities for corporate outbound investment. This study examines the impact mechanism of the BRI on corporate financing structures. Based on a sample of China’s A- share listed companies from 2008 to 2024, the empirical analysis employs a Difference-in-Differences model across single and multiple time points. The findings indicate that the BRI significantly reduces the proportion of debt financing among participating enterprises. This effect is particularly pronounced in non-infrastructure industries and for firms with high market competitiveness and strong solvency. Further analysis reveals that this impact is achieved through two main pathways: first, by enhancing a firm’s market competitiveness, which optimizes its financing choices, and second, by strengthening government policy support, which improves its financing conditions. The conclusions of this research provide empirical evidence for the micro-level policy effects of the BRI, while also offering a decision-making framework for enterprises to optimize capital structures, mitigate debt risks, and improve their capacity for global resource allocation.

    Chinese Modernization and International Law:An Emerging Power Perspective

    The external dimension of Chinese modernization is characterized by its commitment to“the path of peaceful development,”engaging with international law as an emerging power through a two-fold interaction in the process of development. On the one hand, the rise of emerging powers has challenged the hegemonic status of traditional great powers, destabilizing the established international political and economic order. On the other hand, the motivation and capacity of emerging powers to advance international law have come under scrutiny, highlighting the need to move beyond both the great power-dominated model and the predicament of fragmented development. With the sustained enhancement of their national strength and international influence, emerging powers represented by China have acquired greater voice in the construction of international order through legal, institutional, and systemic participation and innovation, consistently providing public goods to the international community and promoting the democratization of the international order. Chinese modernization transcends the paradigm of international law of great powers embedded in the traditional Western path to modernization, propelling international law toward a more equitable and reasonable direction.

    The World Bank’s new Business Ready (BR) framework mandates that corporate management assumes the obligation to preserve business value, avoid bankruptcy where possible, and, if bankruptcy becomes unavoidable, to file for bankruptcy in a timely manner before the commencement of formal insolvency proceedings. The absence of corresponding provisions in both the Company Law and the Enterprise Bankruptcy Law constitutes a potential point deduction in the BR assessment and reveals a legislative gap that urgently requires addressing within the legal framework. When a company faces financial distress and enters the zone of insolvency, management’s fiduciary duties should no longer be confined to the company and its shareholders

    but should extend to include creditors. This shift represents not only a breakthrough in the scope of traditional fiduciary obligations but also an essential adaptation to market development aimed at protecting creditor

    interests. The framework for management’s obligations prior to bankruptcy proceedings should be constructed by addressing the relevant parties, timing, required measures, and legal liabilities. Such a system aligns with the trends of Company Law reform by reinforcing accountability under the board-centric governance model, meets

    the objectives of Bankruptcy Law by facilitating the rescue of viable enterprises and enabling market-oriented liquidation, and further promotes the development of the pre-reorganization regime. Collectively, these reforms are of profound significance for improving China’s bankruptcy legal system and enhancing the overall quality of the business environment.

    The Cinematic Representation of“Affective–Legal Narrative”and Its Contemporary Value

    In the cinematic expressions of contemporary Chinese film, a narrative practice with distinct indigenous cultural characteristics has emerged—namely, the affective – legal narrative. At its core, this approach systematically incorporates the legal dimension as a structural framework and a central interlocutor within affective storytelling. By examining the evolution of affective–legal narratives in Chinese cinema since the new period, this study identifies significant shifts across three dimensions: spatial construction, character formation, and thematic articulation. Collectively, these shifts contribute to an aesthetic configuration centered on the harmonious integration of affect and law. This narrative turn not only marks an elevation in the artistic value of Chinese cinema, but also reflects the intrinsic demand of a society in transition for a balanced reconciliation between legal rationality and affective ethics.

    Since the founding of the People’s Republic of China in 1949, Tian’anmen Square, originally the inner courtyard of the imperial court, has undergone renovation and reconstruction, becoming a venue for important national ceremonies such as the Founding Ceremony and military parades. In contemporary Chinese cinema, Tian’anmen Square has gradually become an indispensable cultural element, with its spatial image evolving dynamically with the development of the times and the needs of film narration, carrying multiple expressive functions: as a national symbol, it strengthens political connotations through the visual presentation of ceremonial scenes; as a carrier of social reproduction, it portrays social transformation and the situation of the underclass through differentiated audio-visual languages; as a symbol of individual witness, it conveys the nostalgia of youth and the reconciliation of growth through changes in visual style. This paper focuses on the specific presentation methods of Tian’anmen Square in films, combines its classical architectural aesthetic characteristics with contemporary political symbolic significance, analyzes how different films shape this space through lens language and narrative strategies, and further explains the cultural connotations of the country, society and individuals behind it.

    New Trends in the Development of Contemporary French Film Theory — Reconsidering Jacques Aumont’s Image Centered Approach to Film Studies

    The 1980s marked a turning point in French film theory. Jacques Aumont conceives cinema asan art of moving images. In the 1990s, he articulated a manifesto for image studies, rejecting content-basedanalysis and the application of pre-established theoretical frameworks. Instead, he argues that analysis shouldfocus on the image itself, advocating concrete analysis and an internalist approach. This methodological shiftplayed a decisive role in the rise of image-centered aesthetic research. Aumont broke away from the mimeticparadigm by defining images as "objects produced by socially constituted human beings, which are referentialand exchangeable. As a semiotic system, the image generates meaning and thought. Film analysis, therefore,should address the essential level of the imagenamely, the problem of expression and its internal operationalmechanisms. By placing the image at the core of film analysis, Aumont returned to the aesthetic reflection onsensation, thereby constructing a knowledge system of cinema and cinematicity through image analysis. Thisapproach represents an ontological mode of film studies and delineates a pathway from sensibility to rationality.

    Fragmentation or Distraction: From Mediated Body to Negative Subject

    Since the advent of the digital age, the mediatization of the body has become a prominent themeworthy of deep reflection. This issue can be broadly approached in three steps. First, it is necessary to clarify therelationship between the body, image, and media. This will reveal the close connection between the body andmedia while also enabling a deeper understanding of the central concept af body image. Second, throughouthuman history, the body image has faced the risk of abstraction and symbolization. This tendency is cleadyevident in the critiques of consumer and digital societies by Baudrillard and Bordo. Third, although turning to amore comprehensive body schema may appear to offer a solution, the binary opposition between the normal andthe pathological presupposed within it further limits this potential. Thus, within the phenomena of fragmentationand distraction produced by technological mediatization, within the oscillating ecart between humans andtechnology, and within the negative dimension opened up by the unthought, we can further reflect on the body'salternative"uses”.

    The Corporeality of Media:A Multi-perspectival Inquiry into Media-Body Relations

     So far, the mediumistic study of media has gone through a series of turns, including the formalturn and the material tumn that emerged in recent years. The formal tum is somewhat ambiguous. It is not somuch interested in revealing the fomal cause of each medium as in viewing each medium as a fomal cause,thereby articulating its psychic and social impact. The material turn is a response to and a criticism ofimmaterialism, and a reaction against the trend of virtualization. The difference between material andnonmaterial is a difference in energy levels. What exactly is the essence of media? Perhaps the fomal turn andthe material turn are both off the mark. French phenomenologist Michel Serres takes us back to humanism andinspires us to understand media using the human body as the point of departure. He puts fonwardexternalizationism," which is distinct from MeLuhan's "extensionism." This view gives a new meaning to theancient Greek maxim, "Know thyself." The human body is both the source and the destination of myriad media.Our pure and simple body appears in all media. All media return to our pure and simple body. In an era whenaction is increasingly becoming tele-action, when social interactions are increasingly disembodied, bringinginto focus the corporeality of media and investigating the multifaceted relationship between media and the bodyconstitutes an "untimely" (in a Nietzschean sense) theoretical intervention. In this sense, the corporeal turn inmedia theory is veritably going against the fashion but has been willed into existence by the total situation.

    Since 2018, the body as a communicative interface has gradually become a focal concern incommunication studies, bringing the study of gestures into renewed view. This line of inquiry can be traced backto Darwin's theory of evolution; building on this foundation, Mead developed symbolic interactionism, placinggestures at its core. However, by overemphasizing the primacy of symbols and language, Mead failed torecognize the technologized dimension of gestures. From the perspective of embodied phenomenology, VilemFlusser identified the role of technical objects within gestures. In today's era of digitally intelligent media,digital technologies permeate every facet of social media users gestural exchanges. In this process, the bodyretreats, occluded by digital interfaces, and human communication is subsumed into vast digital infrastructures.Although Flusser hoped that apparatuses would enable freer communication among people, it has becomeinereasingly evident that individuals are, to a growing extent, communicating primarily with the apparatusesthemselves.

    Research on the Impact of Digital Responsibility of Content Platforms on Creators’Continuous Content Generation

    Creators' continuous content generation detemines the activity level and ecological health ofcontent platforms. However, the accelerated expansion of platform power and the frequent occurrence ofresponsibility-related incidents pose threats to the protection of creators' rights and interests, which maynegatively affect their willingness and capacity to engage in continuous content generation. Drawing onaffordance - actualization theory, this study conducted semi-structured in-depth interviews with 20 creatorsfrom content platfoms such as Douyin, Xiaohongshu, and bilibili. The findings indicate that creatorsperceptions of the digital responsibility of content platforms primarily encompass three core dimensions:responsibility for data privacy risk governance, responsibility for governing the alienation of algorithmicmechanisms, and responsibility for content ecosystem governance. Trust, emotion, and traffic mechanismsfunction as key mediating mechanisms through which the digital responsibility affordances of content platformsexert their effects. Creators who experience deficiencies in the digital responsibility af content platforms tend toadopt coping strategies such as content "desensitization," transformation, and psychological adjustment.

    In contemporary society, the digital transformation of labor forms is reshaping the foundationallogic of global production relations. Digital labor, deeply entangled with capital and technology, has becomealienated into a novel regime of power and discipline. Within the capitalist mode of production, the decline oflabor allocation in the presence of intelligent machines, the hegemonic monopolization of digital means ofproduction, the savage effects of digital capital, and the institutional failure of data-factor income distributionhave together led to an exponential exacerbation of polarization between capital and labor, inflicting systemicdamage on frameworks of social fairness and justice. As a socialist country, China has consistently taken the joyand purpose of labor, as well as the advancement of common prosperity for all, as the compass of distributivejustice. By constructing a "labor-led" legal framework for human-machine distribution, clarifying the publicownership attribute of digital means of production, developing a responsive regulatory model for digital capital,and advancing the reforms of "labor empowermen" in the data-factor contribution and data property rights,China offers an institutional paradigm for global digital economic governance that coordinates fairness andefficiency.

    Digital Power Expansion: Ideological Risks and Countermeasures in China

    In the digital era, the expansion of digital monopoly capitaldriven by the dual logic of profitmaximization and geopolitical power contestation-poses significant challenges to China's ideological securitythrough capital accumulation, technological empowerment, and international political rivalry. Under the guiseof "technological neutrality," digital monopoly capital penetrates, fragments, and manipulates ideologicaldissemination in China. This article proposes a three-dimensional framework to counter such risks: institutionalregulation, intelligent governance, and civic literacy cultivation. At the level of institutional regulation, Chinashould strengthen antitrust oversight of digital capital, clarify regulatory boundaries for sentiment analysistechnologies, and establish risk classification and collaborative supervision mechanisms. At the level ofintelligent governance, mainstream media must enhance the humanistic and participatory dimensions of publicopinion communication, constructing an intelligent, human-centered, and synergistic discourse ecosystem. Atthe level of civic literacy cultivation, the cultivation of digital citizenship requires tripartite empowerment acrossstate, society, and individual actors, foming a co-govemance framework for digital competence.

    From the“Fragment on Machines”to the“Fragment on Data”:Deepening the Critical Logic of Marx’s View of Machines against Digital Capital

    With Marx’s“Fragment on Machines”as the theoretical point of departure, the underlying logic governing the relations between machinery, labor, and capital within the capitalist mode of production is revealed. While machinery propelled a colossal leap in productive forces, under the dominion of capital, it evolved into the materialized form of an exploitation mechanism. It supplanted workers’skills and rhythms, reducing the laboring subject to a mere appendage, thereby precipitating a comprehensive alienation of the labor process, the product of labor, and the human species-being (Gattungswesen). In the era of digital capitalism, the modality of capital control has shifted from material machine systems to virtual architectures centered on data, algorithms, and computing power. Data has emerged as the new means of production, while algorithms have replaced mechanical rhythms as the novel mechanism of labor discipline. By monopolizing platforms and data flows, capital achieves a more covert and flexible form of exploitation. The boundary between labor and non-labor is dissolved; human attention, affect, and behavior are continuously captured and transmuted into sources of value. Consequently, alienation extends from the material realm to the cognitive and spiritual dimensions, manifesting as algorithm-driven behavioral manipulation and the colonization of consciousness. The transition from the“Fragment on Machines”to the“Fragment on  data”demonstrates the historical continuity of capital’s exploitation logic, evolving from the explicit to the implicit. Confronting the pervasive penetration of digital capital, it is imperative to be guided by the Marxist spirit of technological critique. We must re-examine the power structures and subjective conditions within data society, seeking intellectual pathways to transcend algorithmic domination and data alienation, ultimately striving for the reunification of technological progress with human emancipation.

    The Laborization of Digital Games: A Critique Based on Marxist Political Economy

    As digital platforms become deeply embedded in daily life, digital games are evolving from leisure and entertainment into a new form of labor, an inevitable result of the development of platform capitalism. Examined through the lens of Marxist political economy, gaming behavior under specific conditions has already acquired the fundamental characteristics of labor: players’online duration and operations are programmed by systems and transformed into“digital labor time”available for platform extraction; the resulting behavioral data, creative content, and social relations become unpaid raw materials for capital valorization. Analysis shows that from“gold farming”to data production, a substantial volume of gaming activities essentially participate in value creation. However, the vast majority of the resulting surplus value is captured by platforms

    through technological monopolies and rule design, forming a concealed exploitation of“play as labor.” Therefore, it is imperative to recognize the power asymmetry behind the laborization of games and explore possible paths to counter platform monopolies and strive for digital rights.

    Social Coerciveness of Digital Power and Synergistic Regulation within the Holistic Legal Order

    In the digital era, platforms have de facto exercised digital power endowed with social coerciveness. The abuse of such power directly infringes upon various legal interests, necessitating effective legal constraints. However, the existing regulatory paradigm, characterized by“strengthening the mid-stream while neglecting the upstream and downstream,”proves inadequate for the comprehensive governance of digital power. Instead, adopting a holistic legal order perspective, regulation should be anchored in mid-stream controls while leveraging upstream mechanisms for prevention and downstream mechanisms for assurance, thereby achieving synergistic governance of digital power. On one hand, the self-regulatory function of platform enterprises should be activated to shape an upstream risk prevention mechanism. This requires platforms to strengthen internal management structures and assume external risk management responsibilities. On the other hand, the cautious regulatory function of criminal law should be harnessed to construct a downstream assurance mechanism. This entails reinterpreting criminal provisions to address direct infringements arising from the abuse of digital power by platforms. Furthermore, guided by the principles of the“Red Flag Rule”and the“Safe Harbor Rule,”criminal law should also regulate indirect aiding and abetting behaviors associated with such abuse.

    On the Institutional Construction of Data Rights Registration

    Data rights registration is pivotal to resolving the bottlenecks in data trading. The“three data rights”established in the Opinions of the CPC Central Committee and the State Council on Building a Basic Data System to Better Leverage the Role of Data Factors do not constitute exclusive or absolute property rights; consequently, the“data property rights registration”envisioned in this document is, in essence,“data rights registration.”Given the diverse origins of data rights and the varied modalities of data transactions, data rights registration should entail differentiated legal effects. Specifically, the probative force, opposability effect, and constitutive effect inherent in traditional property rights registration systems are all applicable in this context. It is advisable for the data rights registration framework to evolve gradually from an integrated model toward a centralized model. In this transition, it is imperative to address the functional separation between data exchanges and data rights registration authorities, as well as to achieve nationwide unification of the data rights registration system. Defining the core review responsibilities of data rights registration authorities hinges on clarifying both the scope of review matters and the methodologies employed. Should registration authorities or their personnel fail to fulfill their duty of reasonable review, thereby causing damage to right holders or third parties, or resulting in other serious consequences, they shall bear corresponding legal liability.

    The Undecidable Film as Thought Experiment

    The“undecidable film”refers to a cinematic form characterized by structural ambiguity and semantic indeterminacy. In recent years, this emerging form has entered mainstream commercial production, giving rise to  representative works such as Barbie and Her Story. The undecidable film is not only a product of the film industry’s restructuring and transformation in response to various challenges since the new century but also represents a promising new direction for its future development. However, the emergence of this new form poses significant challenges to film scholarship and criticism. In this context, the research trajectory of“film as thought experiment,”proposed by film theorist Thomas Elsaesser, offers profound theoretical inspiration for analyzing the undecidable film. It is argued that approaching these films as thought experiments allows for a deeper understanding of their function in navigating contemporary cultural contradictions.

    By adopting the philosophical perspective of Event Theory to comprehend image history and reflect on its generative logic, this study highlights the innovative significance that image events bring to the theoretical morphological transformation of Historical Poetics. Derived from historical processes, historical cognition, and historical discourse, Historical Poetics has evolved into three theoretical forms: speculative, critical, and discursive. Traditionally, grounded in the“history-literature”paradigm, its inquiries have focused on historical causality, teleology, and textuality, yet have consistently lacked sufficient attention to the dimensions of image and event. In contrast, the Event Theory that emerged in the 21st century possesses the capacity to synthesize the numerous binary oppositions triggered by traditional historical texts, implying that the

    image event also holds the potential to bridge the theoretical dilemmas of Historical Poetics. In light of this, image events can not only expand the research boundaries of Historical Poetics but also offer inspiration for its innovative development at the theoretical level. This facilitates Historical Poetics in breaking free from the constraints of“textualism”and advancing towards an“Event-Oriented Historical Poetics.”

    Script Murder Mystery as a New Genre in the Era of Media Convergence

    The development of new media and technologies has facilitated the convergence of media and arts, triggering innovations in artistic genres and giving rise to new forms of expression and aesthetics. As a genre with multi-media attributes, script murder mystery (jubensha) constructs a cross-media interactive form under the dual goals of enhancing literary expression and gaming experience. It integrates various media formats—text, images, video, audio, comics, VR, and AR—into a gamified, hypertextual, and visualized genre. The functions of this genre are threefold: satisfying young people’s need for“low-stakes socialization,” enabling youth groups to acquire diverse life experiences and new forms of self-identity through role-playing, and providing a channel for emotional catharsis and a window for psychological counseling. By innovating traditional narrative paradigms, script murder mystery constructs a new narrative morphology that transcends boundaries, positing“narrative as a fusion of gameplay, socialization, and experience.”Furthermore, the success of its narrative logic has influenced narrative innovations in novels, interactive fiction, and film/ television dramas. Specifically, films of the script murder mystery, characterized by their puzzle-solving gameplay narrative style and a visual aesthetics serving this style, endow cinema with new vitality, demonstrating significant potential to evolve into a distinct“new genre.”

    Against the backdrop of the booming development of China’s cultural heritage sector, the conceptual evolution from“cultural relics”to“cultural heritage”reflects an expansion in the scope of museum protection and research, shifting from static material objects to living culture. Correspondingly, the function of museums has gradually transformed from collection-centered institutions for research into cultural hubs that prioritize both artifacts and people. At the disciplinary level, museums share a common research object with archaeology and cultural relics studies, fostering close interdisciplinary interactions. This intersectionality highlights both the possibility and necessity of systematically integrating and leading related theories under the umbrella of Heritage Studies as a first-level discipline. As a pivotal field for cultural heritage knowledge practice, museums can leverage interdisciplinary approaches to constructing a value-centric circular system, thereby elevating Cultural Heritage Studies into a foundational platform that integrates related disciplines and providing the theoretical underpinning and developmental impetus for establishing a system of cultural heritage disciplines with Chinese characteristics.

    Does Depth of Thought Equate to a System of Thought? —A Discussion with Professor Yang Naiqiao on the Nature of Qian Zhongshu’s Works

    Professor Yang Naiqiao argues that Qian Zhongshu’s works, such as Limited Views: Essays on Ideas and Letters (Guanzhui Bian), construct“an aesthetic systematic structure capable of bridging (Chinese and Western) traditions and revealing universal laws.”This assertion raises a fundamental question: does  intellectual depth equate to a system of thought? Furthermore, does revealing the inherent system of the object of interpretation amount to the construction of a theoretical system by the interpretation itself? While depth of thought is characterized by profound insight and penetrating analysis, a system of thought entails an organized construction across linear, planar, and multidimensional axes. It is widely acknowledged that Qian’s works exemplify the former rather than the latter. This perception is grounded in both the intuitive reading experience and scholarly judgment, and is further attributable to Qian Zhongshu’s own profound conviction and intellectual temperament—his methodology inherently reflects his ontology and axiology. In the contemporary context of rapid artificial intelligence evolution, Qian Zhongshu’s mode of reading and contemplation retains its enduring value and significance.

    Convergence between Confucian Ethics and Contemporary Virtue Ethics: An Examination Based on“The Gentleman’s Vigilance in Solitude”and“Agent-Centeredness”

    Although Confucian ethics and contemporary virtue ethics originate from distinct civilizations separated by vast temporal and spatial distances, significant convergences are observed regarding the establishment of the moral agent, the pathways for cultivating virtue, and the methods for sustaining moral character. Through an examination of“junzi shen du”(the gentleman’s vigilance in solitude) and“agentcenteredness,”it is argued that the junzi (exemplary person) in Confucianism and the virtuous agent in contemporary virtue ethics serve as the foundational moral subjects for their respective theoretical frameworks. The Confucian ideal of“harmonizing the internal and external”and the virtue ethical principle that“character takes precedence over action”are presented as distinct yet complementary approaches to moral cultivation. In both traditions, the necessity for inner qualities to manifest outwardly“( formed within, expressed without”) is emphasized, with priority given to internal disposition and self-cultivation. Furthermore, gongfu (selfcultivation practices) in Confucianism and phronesis (practical wisdom) in contemporary virtue ethics are identified as the respective strategies for nurturing and sustaining virtue. The importance of the agent’s practical engagement and spiritual refinement, as well as the indispensable role of virtue or character in guiding concrete actions, is underscored by both systems. While these profound convergences are highlighted, subtle yet meaningful distinctions between the two ethical traditions are also acknowledged.

    Socialization Approach in International Chinese Language Education: Theoretical Construction of a Dynamic Relationship Model

    The socialization approach in International Chinese Language Education (ICLE) represents an inevitable strategic response to the disparity between the surging global demand and domestic supply constraints. The systemic risks and challenges faced by different agents during its advancement serve as the core motivations for constructing a four-dimensional dynamic model and practical pathways. Through theoretical construction, risk analysis, model design, and pathway optimization, this study yields the following conclusions: First, a robust theoretical framework is established, grounded in Public Goods Theory,

    Collaborative Governance Theory, and Ecosystem Theory. Second, an analysis of the systemic risks facing ICLE and the transformation dilemmas faced by various stakeholders provides critical directional guidance for practical implementation. Third, a four-dimensional Dynamic Relationship Model encompassing the “Government-Universities-Social Forces-Learners”is constructed. This model facilitates the complementary advantages and dynamic adaptation of the three core mechanisms, offering a framework-level directive for the socialization of ICLE. Finally, when universities, social forces, the government, and academic experts respectively transform into distinct empowering agents, they can effectively synergize to advance socialization, thereby resolving the challenges and mitigating the risks currently confronting ICLE.

    The International Communication of Chinese Culture from the Perspective of the“Expression-Driven”Teaching Theory: Characteristics, Mechanisms, Limitations and Breakthroughs

    The“Expression-Driven”teaching theory provides new concepts and methodologies for the international communication of Chinese culture. Integrating literature analysis and case studies, this study explores the core characteristics of international Chinese cultural communication through the lens of “Expression-Driven”teaching theory. The analysis reveals a paradigm shift across four key dimensions: from “knowledge coverage”to“expression competency construction”; from“teacher-centeredness”to“learnercenteredness”; from “closed classroom settings” to “authentic and simulated interactions”; and from “knowledge assessment”to“expression effect orientation.”Furthermore, it elucidates the underlying logic for reconstructing the Chinese cultural“learning-communication”chain, anchored firmly in expression needs. However, practical applications of the“Expression-Driven”teaching theory in cultural communication reveal significant limitations. These include dual deficits in“expression competence”and“cultural literacy,”the “decontextualization”of cultural symbols, a mismatch between expression needs and realities, constraints on “expression effect”imposed by cross-cultural differences, insufficient enabling conditions for“expression drive,”and a disconnection between“expression  behavior”and“communication goals.”To address these challenges, this study proposes breakthrough pathways across five dimensions: enhancing subject competency, optimizing content adaptation, innovating contextual support, strengthening resource allocation, and refining effect assessment. These initiatives aim to provide both theoretical grounding and operational solutions to catalyze a significant leap in the effectiveness of international Chinese cultural communication in the new era.
