Abstract:  With the advancement of the era of big data, the interest conflicts between data protection and data utilization have been increasingly prominent due to the chaotic competition in the data industry. The usercentered unilateral protection framework has been unable to meet the demand for data utilization and innovation in the current era of data economy. In the process of building data right system, we should distinguish the status and properties of data rights, take into account the bidirectional dynamics of data economy and regulate data users’ and business dealers’ respective rights and interests by identifying personal information from digital assets, so as to form a more diversified data management system and facilitate the most optimized protection and utilization of big data resources.
