Abstract: In strengthening the lawful system, the construction of procurator system is significant. The procuratorial power of China, independent of the legislative power, executive power and jurisdiction of the state-power administration, belong to a special superintendence. And its quality decides the procurators’ quality, professional feature and functional allocation. In Chinese academia, there is a saying that procurators are simply administrators or law-officers, which, without analysis of peculiar attributes contained in China’s procuratorial power, does not accord with our polity and current legal system.
